City Council Regular Meeting — 12/OS/OS <br />DRAFT Minutes - Page 29 <br />Maschka moved, Klausing seconded, approval of a contract <br />between the City of Roseville and the law firm of Jensen, Bell, <br />Converse & Erickson, P.A., for 2006 Prosecution Retainer as <br />outlined in the agreement letter of November 17, 2005, for <br />prosecutorial legal services. <br />Councilmember Kough questioned why the code enforcement <br />provision in having the issue come before the City Council prior <br />to court hadn't been implemented into the new contract. <br />City Manager Beets opined that previous City Council <br />discussions had provided a majority opinion to delete that <br />contract provision. <br />Mayor Klausing spoke in support of deleting that provision. <br />Councilmember Kough, while supportive of the proposed City <br />Prosecutor firm, spoke in support of reinstating that provision. <br />Councilmember Schroeder, while not having concerns that the <br />clause was deleted, spoke in opposition to the motion due to his <br />previously-expressed belief that the City needed to look at other <br />firms, rather than retaining the same firm for so many years, thus <br />providing more opportunities for other firms to gain experience <br />with the City's needs. <br />Discussion ensued, including the contract provisions and <br />potential approval as it stands as a contract; and Council <br />adoption of a policy related to code or ordinance provisions with <br />respect to criminal review of complaints. <br />Mayor Klausing suggested that the City Council approve the <br />contract language as presented; and have a future policy <br />discussion as to Council review prior to the City Prosecutor <br />pursuing criminal charges. <br />Councilmember Ihlan spoke in support of approving the contract <br />as presented; with an understanding to the City Prosecutor that <br />items were to come before the City Council before prosecutorial <br />determinations were made. <br />
