City Council Regular Meeting — 12/OS/OS DRAFT Minutes - Page 29 Maschka moved, Klausing seconded, approval of a contract between the City of Roseville and the law firm of Jensen, Bell, Converse & Erickson, P.A., for 2006 Prosecution Retainer as outlined in the agreement letter of November 17, 2005, for prosecutorial legal services. Councilmember Kough questioned why the code enforcement provision in having the issue come before the City Council prior to court hadn't been implemented into the new contract. City Manager Beets opined that previous City Council discussions had provided a majority opinion to delete that contract provision. Mayor Klausing spoke in support of deleting that provision. Councilmember Kough, while supportive of the proposed City Prosecutor firm, spoke in support of reinstating that provision. Councilmember Schroeder, while not having concerns that the clause was deleted, spoke in opposition to the motion due to his previously-expressed belief that the City needed to look at other firms, rather than retaining the same firm for so many years, thus providing more opportunities for other firms to gain experience with the City's needs. Discussion ensued, including the contract provisions and potential approval as it stands as a contract; and Council adoption of a policy related to code or ordinance provisions with respect to criminal review of complaints. Mayor Klausing suggested that the City Council approve the contract language as presented; and have a future policy discussion as to Council review prior to the City Prosecutor pursuing criminal charges. Councilmember Ihlan spoke in support of approving the contract as presented; with an understanding to the City Prosecutor that items were to come before the City Council before prosecutorial determinations were made.
