City Council Regular Meeting — 12/OS/OS <br />DRAFT Minutes - Page 28 <br />Mr. Beets presented, via individual contracts, results of those <br />negotiations; noting minor adjustments represented in <br />arrangements with vendors for each contract and the modest <br />improvements in contractual agreements achieved. Mr. Beets <br />reviewed those specifics (i.e., scope of services defined and <br />clarified in the City Attorney contract; reductions in the monthly <br />retainer for the City Prosecutor; and minimum floor prices <br />established for revenue sharing in the recycling contract, as well <br />as transition from every other week to weekly pickup if deemed <br />desirable). Mr. Beets recommended individual vote for each <br />contract; and advised that the City Attorney had reviewed each <br />contract. <br />Maschka moved, Klausing seconded, approval of a contract <br />between the City of Roseville and the law firm of Ratwik, <br />Roszak & Maloney, P.A., for civil legal services, at specified <br />annual retainers for a three year term, expiring October 31,2008. <br />Councilmember Ihlan reiterated her frustration in the �k'P <br />process and majority Council decision to continue seeking <br />services of current providers; and questioned specific charges by <br />the proposed firm for meals and faxes. Councilmember Ihlan <br />also noted that there was no alternative dispute resolution clause <br />in either the City Attorney or City Prosecutor contracts; and <br />questioned whether it was appropriate in the City Attorney <br />contract to include an interest charge for payments over 30 days. <br />City Attorney Anderson noted that the meal reimbursement had <br />never been invoked and would only be done in the case of an <br />attorney being required to be out of the jurisdiction; and opined <br />that the fax fee was a standaxd rate for legal firms. <br />City Manager Beets observed that the alternative dispute <br />resolution clause had not come up during negotiations; and that <br />the City didn't use a payment schedule for attorney fees. <br />Roll Call <br />Ayes: Kough; Maschka; Schroeder and Klausing. <br />Nays: Ihlan. <br />
