Department Approval <br />�' <br />Item Description: <br />BACKGROUND <br />l�'�, <br />Jy <br />REQUEST FOR COUNCIL ACTION <br />Date: 9-14-09 <br />Item No.: 12.a <br />City Manager Approval <br />Community Development Department Request to Perform a City <br />Abatement for Unresolved Violation of City Code at 2815 Rice Street. <br />• The subject property is a vacant/closed gas station. <br />• The current owner is M� Sterling Properties, Inc. <br />• Notice was sent July 24, 2009, requesting violations be corrected. <br />• Current violations include: <br />• Junk and debris deposited on site and not removed (a violation of City Code Section <br />407.02.D). <br />• A status update, including pictures, will be provided at the public hearing. <br />POLICY OBJECTIVE <br />The City goals within the Comprehensive Plan are to protect and improve property values (Goal 3, 4, <br />and 5; page 6 and, Section 3) and to adhere to performance standards which protect the integrity of the <br />housing units and the neighborhood (Policy 6, page 8, Section 3). <br />FINANCIAL IMPACTS <br />City Abatement: <br />An abatement would encompass the following: <br />• Removal and disposal of all junk/debris deposited on site and in trash bins: <br />o Approximately - $350.00 <br />• Total: Approximately - $350.00. <br />In the short term, costs of the abatement will be paid out of the Community Development Department <br />budget. The property owner will then be billed for actual and administrative costs. If charges are not <br />paid, staff is to recover costs as specified in Section 407.075.
