(g) Exception for Distribution into a Health Savin�s Account. <br />A distribution from the medical reimbursement plan that does not exceed <br />the lesser of the balance in such arrangement on September 21, 2006, or as <br />of the date of such distribution, the maximum amount allowable by law, <br />and is contributed by the Company directly to the health savings account <br />of the employee before January 1, 2012 shall not violate Section 5.2.5 or <br />its subparagraphs of this Plan. Such term shall not include more than one <br />(1) distribution with respect to any medical reimbursement plan. <br />(h) Separate Written Plan. For purposes of the Code, <br />paragraph 5.2.2 shall constitute a separate written plan providing <br />for the reimbursement of Medical Care expenses. To the extent <br />necessary, other provisions of the Plan are incorporated by <br />reference in paragraph 5.2.2. <br />(i) HIPAA Privacy and Security. Paragraphs (i) <br />through (m) apply to the Medical Reimbursement Plan only. <br />Definitions of capitalized terms in this paragraph are taken from <br />the statute and regulations of the Health Insurance Portability and <br />Accountability Act of 1996 found in 45 CFR § 164.501 et al. The <br />HIPAA Privacy Rules and Security Standards stated in this section <br />will become effective for the Plan when required under the <br />applicable statutes and regulations. The plan will use and disclose <br />"protected health information" (PHI) and "electronic protected <br />health information" (EPHI) for purposes related to health care <br />32 City of Roseville MPD <br />
