(p) "Plan Sponsor" means the Employer. <br />(q) "Plan Year" means the twelve-month period ending December 31. <br />(r) "Qualifyin� Individual" means a"qualifying individual" as defined <br />in Section 21(b) of the Code, which includes, on the Effective Date of this Plan, <br />(i) a Dependent of a Participant who is under the age of thirteen (13), with respect <br />to whom the Participant is entitled to an exemption under Section 151(c) of the <br />Code, and (ii) a Participant's Dependent or spouse who is physically or mentally <br />incapable of caring for himself or herself. <br />(s) "Spouse" means an individual who is legally married to the <br />Participant as determined under applicable state law and who is treated as a <br />spouse under the Code. <br />(t) "Status Chan�e" includes the events listed as well as other events <br />allowed by law and with respect to a Participant means an event that allows a <br />participant to make changes to his or her elections for legitimate changes in status <br />which generally means on account of, and corresponding with, a change in status <br />that affects eligibility for coverage. The Employer is the Plan Administrator and <br />has sole discretion, on a uniform and consistent basis, to determine whether a <br />status change has occurred and whether the requested election change is consistent <br />with the status change. <br />For the Health Plan these events are: Special enrollments as defined by Code <br />Section 9801(f) including a gain of a dependent through marriage, birth or adoption, or <br />loss of eligibility for other coverage; A change in legal marital status due to marriage, <br />9 City of Roseville MPD <br />
