Notice to Proceed. The improvements shall be installed in accordance with City standards, <br />ordinances, and the plans and specifications which have been prepared by a competent <br />registered professional engineer, furnished to the City for review, and approved by the City <br />Engineer. <br />�0 1. The Developer shall obtain all necessary permits from the Minnesota Pollution Control <br />11 Agency (MPCA) , Minnesota Department of Health (MDOH) , and other agencies before <br />12 proceeding with construction. Copies of these permits must be provided to the City Engineer. <br />�3 2. The Developer or his engineer shall schedule a preconstruction meeting at a mutually <br />�4 agreeable time at City Hall with all the parties concerned, including City staff, to review the <br />15 program for the construction work. <br />�6 3. The Developer represents to the City that the plat complies with all City, County, <br />�7 Metropolitan, State and Federal laws and regulations including, but not limited to: subdivision <br />18 ordinances, zoning ordinances and environmental regulations. If the City determines that the <br />19 plat does not comply, the City may, at its option, refuse to allow construction or development <br />20 work in the plat until the Developer does comply. Upon the City's demand, the Developer shall <br />2 � cease work until there is compliance. <br />22 <br />23 F. Time of Performance. The Developer shall install all required improvements enumerated in <br />24 Paragraph C, which will serve the plat by October 31, 2010. Wear course of asphalt and all <br />25 landscape and restoration shall be installed by October 31, 2010. The Developer may, <br />26 however, forward a request for an extension of time to the City. If an extension is granted, it <br />27 shall be conditioned upon updating the security posted by the Developer to reflect cost <br />2s increases and the extended completion date. <br />29 G. Inspection. The Developer shall provide the services of a Residential Project Representative <br />30 and assistants at the site to provide continuous observation of the Contractor's work. <br />31 1. The Developer shall provide the City Engineer a minimum of one business day notice prior <br />32 to the commencement of the underground pipe laying and service connection; and prior to <br />33 subgrade, gravel base and bituminous surface construction. <br />34 2. Developer's failure to comply with the terms of this section shall permit the City Engineer to <br />35 issue a stop work order which may result in a rejection of the work and which shall obligate the <br />36 Developer to take all reasonable steps, as directed by the City Engineer to ensure that the <br />37 improvements are constructed and inspected pursuant to the terms of this Agreement; and shall <br />38 further result in the assessment of a penalty, in an amount equal to 1% per occurrence, of the <br />39 amount of the security required for Developer improvements. <br />40 H. Engineering Coordination. A City Engineering Coordinator shall be assigned to this <br />4� project to provide further protection for the City against defects and deficiencies in the work <br />Page 3 of 8 <br />
