Notice to Proceed. The improvements shall be installed in accordance with City standards, ordinances, and the plans and specifications which have been prepared by a competent registered professional engineer, furnished to the City for review, and approved by the City Engineer. �0 1. The Developer shall obtain all necessary permits from the Minnesota Pollution Control 11 Agency (MPCA) , Minnesota Department of Health (MDOH) , and other agencies before 12 proceeding with construction. Copies of these permits must be provided to the City Engineer. �3 2. The Developer or his engineer shall schedule a preconstruction meeting at a mutually �4 agreeable time at City Hall with all the parties concerned, including City staff, to review the 15 program for the construction work. �6 3. The Developer represents to the City that the plat complies with all City, County, �7 Metropolitan, State and Federal laws and regulations including, but not limited to: subdivision 18 ordinances, zoning ordinances and environmental regulations. If the City determines that the 19 plat does not comply, the City may, at its option, refuse to allow construction or development 20 work in the plat until the Developer does comply. Upon the City's demand, the Developer shall 2 � cease work until there is compliance. 22 23 F. Time of Performance. The Developer shall install all required improvements enumerated in 24 Paragraph C, which will serve the plat by October 31, 2010. Wear course of asphalt and all 25 landscape and restoration shall be installed by October 31, 2010. The Developer may, 26 however, forward a request for an extension of time to the City. If an extension is granted, it 27 shall be conditioned upon updating the security posted by the Developer to reflect cost 2s increases and the extended completion date. 29 G. Inspection. The Developer shall provide the services of a Residential Project Representative 30 and assistants at the site to provide continuous observation of the Contractor's work. 31 1. The Developer shall provide the City Engineer a minimum of one business day notice prior 32 to the commencement of the underground pipe laying and service connection; and prior to 33 subgrade, gravel base and bituminous surface construction. 34 2. Developer's failure to comply with the terms of this section shall permit the City Engineer to 35 issue a stop work order which may result in a rejection of the work and which shall obligate the 36 Developer to take all reasonable steps, as directed by the City Engineer to ensure that the 37 improvements are constructed and inspected pursuant to the terms of this Agreement; and shall 38 further result in the assessment of a penalty, in an amount equal to 1% per occurrence, of the 39 amount of the security required for Developer improvements. 40 H. Engineering Coordination. A City Engineering Coordinator shall be assigned to this 4� project to provide further protection for the City against defects and deficiencies in the work Page 3 of 8
