1. Site Grading and Turf Restoration. Site grading improvements shall include common excavation, subgrade correction, embankment and pond excavation. Turf restoration shall include seeding, mulching and erosion control. 4 a) The Developer shall submit to the City a site grading and drainage plan for the entire 5 plat acceptable to the City showing the grades and drainage for each lot prior to 6 installation of the improvements. 7 b) All improvements to the lots and the final grading shall comply with the grading plan s as submitted 9 2. Restoration of existing streets: Curb cuts and street cuts shall be reconstructed to match �0 existing street typical section. � � a) Curbs proposed to be replaced or relocated shall have a bituminous saw cut out an �2 adequate distance to allow for proper compaction. 13 3. Erosion control. Prior to site grading and before any utility construction is commenced or �4 building permits are issued, the erosion control plan shall be implemented, inspected and �5 approved by the City. The Developer shall meet all requirements of the City's Erosion Control 16 Ordinance including but not limited to the following. �7 a) No construction activity shall be allowed and no building permits shall be issued 18 unless the plat is in full compliance with the erosion control requirements. 19 b) Measures shall be installed in compliance with MPCA NPDES permit requirements. 20 c) The City shall inspect the site periodically and determine whether it is necessary to 2 � take additional measures to address erosion. 22 d) To remove dirt and debris from streets that has resulted from construction work by 23 the Developer, its agents or assigns, the Developer shall sweep West Snelling Drive 24 on a weekly basis or more frequently as directed by the City Engineer until the site is 25 stabilized. Developer must sweep roadways with a water-discharge broom apparatus. 26 Kick-off brooms shall not be utilized for street sweeping. 27 e) If the plat development does not comply with the erosion control plan and schedule or 28 supplementary instructions received from the City, after the Developer has received 29 48-hour verbal notice, the City may take such action as it deems appropriate to 30 control erosion. 3� f� The City will endeavor to notify the Developer in advance of any proposed action but 32 failure of the City to do so will not affect the Developer's or the City's rights or 33 obligations hereunder. If the Developer does not reimburse the City for costs 34 incurred hereunder within thirty (30) days, the City may draw down the letter of 35 credit to pay any costs. 36 D. Development Plans. The plat shall be developed in accordance with the following plans. 37 The plans shall not be attached to this Contract. With the exception of the plat, the plans may 38 be prepared, subject to City approval, after entering the Contract, but before commencement 39 of any work in this plat.
