1. Site Grading and Turf Restoration. Site grading improvements shall include common <br />excavation, subgrade correction, embankment and pond excavation. Turf restoration shall <br />include seeding, mulching and erosion control. <br />4 a) The Developer shall submit to the City a site grading and drainage plan for the entire <br />5 plat acceptable to the City showing the grades and drainage for each lot prior to <br />6 installation of the improvements. <br />7 b) All improvements to the lots and the final grading shall comply with the grading plan <br />s as submitted <br />9 2. Restoration of existing streets: Curb cuts and street cuts shall be reconstructed to match <br />�0 existing street typical section. <br />� � a) Curbs proposed to be replaced or relocated shall have a bituminous saw cut out an <br />�2 adequate distance to allow for proper compaction. <br />13 3. Erosion control. Prior to site grading and before any utility construction is commenced or <br />�4 building permits are issued, the erosion control plan shall be implemented, inspected and <br />�5 approved by the City. The Developer shall meet all requirements of the City's Erosion Control <br />16 Ordinance including but not limited to the following. <br />�7 a) No construction activity shall be allowed and no building permits shall be issued <br />18 unless the plat is in full compliance with the erosion control requirements. <br />19 b) Measures shall be installed in compliance with MPCA NPDES permit requirements. <br />20 c) The City shall inspect the site periodically and determine whether it is necessary to <br />2 � take additional measures to address erosion. <br />22 d) To remove dirt and debris from streets that has resulted from construction work by <br />23 the Developer, its agents or assigns, the Developer shall sweep West Snelling Drive <br />24 on a weekly basis or more frequently as directed by the City Engineer until the site is <br />25 stabilized. Developer must sweep roadways with a water-discharge broom apparatus. <br />26 Kick-off brooms shall not be utilized for street sweeping. <br />27 e) If the plat development does not comply with the erosion control plan and schedule or <br />28 supplementary instructions received from the City, after the Developer has received <br />29 48-hour verbal notice, the City may take such action as it deems appropriate to <br />30 control erosion. <br />3� f� The City will endeavor to notify the Developer in advance of any proposed action but <br />32 failure of the City to do so will not affect the Developer's or the City's rights or <br />33 obligations hereunder. If the Developer does not reimburse the City for costs <br />34 incurred hereunder within thirty (30) days, the City may draw down the letter of <br />35 credit to pay any costs. <br />36 D. Development Plans. The plat shall be developed in accordance with the following plans. <br />37 The plans shall not be attached to this Contract. With the exception of the plat, the plans may <br />38 be prepared, subject to City approval, after entering the Contract, but before commencement <br />39 of any work in this plat. If the plans vary from the written terms of this Contract, the written <br />40 terms shall control. The plans are: <br />41 a) Plat <br />Page 2 of 8 <br />
