REQUEST FOR COUNCIL DISCUSSION/DIRECTION
DATE: 01112/04
ITEM NQ: 6. A.
Department Approval: Agenda Section:
DPW DISCUSSION
Item Description: Amendment to text of Shopping CenterZoning Districts within City Code Section
1006 (PF3528)
.1 BACKGROUND:
L. l The Planning Commission, Council and staff have been completing a systematic rewrite of outdated
portions of the City Code for three past three years. Attached is the draft of an ordinance which would
modify the Shopping Center Zoning District language and format. The new fonat consolidates the
dimensional requirements on one page and also consolidates the land uses allowe in each district into
one standard chart, similar to the work that was done earlier for the Residential Zoning Text. Staff has
reviewed this document and changes in the past two years with the Chamber of Commerce and
representativesfrom the shopping centers in the area, who are interested in seeing the language updated
to record that their properties are 1ega11y conforminguses and structures.
].t One of the obvious amendmentadvantages is that it reduces the repetitiveness of the Shopping Center
Zoning text by consolidation. In addition, it allows users to view a comparison of what other business (B-
1 through B-6) districts uses might be allowed (or prohibited). a signiicant changes have been made to
the dimensionalrequirements .
I, 3 This amendment, to Sections 1006.01 through 1006.05, if passed, would eliminate duplicated text in this
section of the code. It would also reine some of the land uses permitted by being more speciic than
simply stating that uses allowed in a B-2 district are allowed in a shopping center district.
I.+ Lot coverage has been eliminated in this proposal. F1oor area ratio has been changed to "1.0", which is
equivalentto the B-3 zone. Building height is clariied as 3 stories above the main 1eve1 entry or 35 feet,
except as approved in a master plan or a PUD. More clarity has been provided in the 24 hour standards,
regardingbuffer,landscaping,loading,lighting, and snow storage.
I. Staff has added the deinition for the shopping center district section, providing a clearer understanding
of the uses which should be allowed therein, and recognized the site plans and permits in effect as of
January, 2000 as the "approved" plan from which a11 future amendments wi11 be calculated.
.1 SUGGESTED ACTION:
Discussion and direction as needed.
Report Prepared by: Dennis Welsch, (651-792-7071)
Attachmen Proposed Ordinance
' 4'.Liodifia-rnTe,Plann in7rn •u bl.tr Files3500-3549\3528_Shapping Center Zoning Text Amendment - Section 1006RCDp-Pf3528 Shopping
Center DistrictAmendment(Ol 1204).doc
