Wolf <br />" Also admitted in Wisconsin <br />** Civil Trial Specialist <br />Certified by the Minnesota <br />State Bar Associarion <br />+ Real Property Law Specialist <br />Certified by the Minnesota <br />State Bar Associarion <br />This letter is in response to your recent questions regarding the compatibility of the <br />positions of advisory commission chair and Councilmember appointed to fill a vacancy until a <br />special election. <br />There is no statute or case law which states that service on an advisory commission is <br />inc;�mpatible with a seat on the city council. Offices are incompatible when their functions are <br />inconsistent so that the pexformance of one results in a conflict with dutifully performing the <br />duties of the other.' We have reviewed the City Code regarding the duties of all the advisory <br />commissions other than the Police Civil Service Commission. <br />Generally, the duties of these advisory commissions are to receive information, hold <br />hearings and advise the City Council. A commission chairperson does not have any additional <br />substantive duties. It does not appear that the duties of the chair, or any of the members, of <br />these commissions are inconsistent with the duties of a Councilmember or that performance of <br />the duties of either position would make it impossible to dutifully perform the duties of the <br />� State ex rel. Hilton v. Sword, 19b N. W. 467 (Minn.l923). <br />
