REQUEST FOR CITY COUNCIL ACTION <br />Department Approval: <br />TP <br />�lr���raved: <br />DATE:02/09/04 <br />ITEM NO: 3.12 <br />Agenda Section: <br />CONSENT <br />Item Description: A request by Zawadski Homes for a Minor Subdivision (Correction) to <br />modify an existingproperty line between 691 & 693 Heinel Circle (PF3553). <br />1.0 REQUESTED ACTION <br />1.1 Zawadsl�i Homes (Steve Zawadsl�i) on behalf of Walter Bauer and Richard Karlen, <br />property owners at 691 & 693 Heinel Circel respectively, has requested the City Council <br />approval of a"Correction" between two legal conforming lots in Roseville. <br />i,� Section 1104.04D specifies the procedures for consideration and approval of a <br />"Correction." Specifically, this section of the City Code states: "Corrections: When a <br />survey of description of a parcel or lot has been found to be inadequate to describe the <br />actual boundaries, approval of a corrective subdivision may be requested. This type of <br />subdivision creates no new lots or streets. The proposed corrective subdivision, in sketch <br />plan form, along with a letter signed by all affected owners agreeing to the new <br />subdivision, shall be submitted to the City Council for approval. No hearing or Planning <br />Commission review is necessary unless the proposal is referred to the Commission by the <br />Community Development Director for clarification. The proposed parcels shall not <br />cause any portion of the e�sting lots, parcels, or e�sting buildings to be in violation <br />of this regulation or the zoning code. A certificate of survey illustrating the corrected <br />boundaries shall be required on all parcels. Within thirty (30) days after approval by the <br />City Council, the applicant shall supply the final survey to the Community Development <br />Director and City Manager for review and approval. After completion of the review and <br />approval by the Community Development Director and City Manager, the survey shall be <br />recorded by the applicant with the Ramsey County Recorder within sixty (60) days. <br />Failure to record the subdivision within sixty (60) days shall nullify the approval of the <br />subdivision. <br />2.0 BACKGROUND <br />2.1 In July of 1949 the Oak Point subdivision was recorded with Ramsey County, creating <br />the two subject lots; Lot 3 and Lot 4, Block 1, Oak Point. In 1951 a home was <br />constructed on the corner lot, Lot 3, Block 1 Oak Point (691 Heinel Drive), which home <br />was removed in 2003. Lot 4, Block l, Oak Point (693 Heinel Circle) stood vacant until <br />2001 when the Karlen home was constructed. In 2003, Lot 3, Block 1, Oak Point <br />received a new home, constructed for the Bauer's. <br />Page 1 of 2 <br />
