third pariy within the Redevelopment Area, condemn or agree to proceed with the condemnation of <br />any property within the Redevelopment Area to assist or facilitate development within such area by <br />any third party. The City acknowledges that Redeveloperhas, duringthe term of this Agreement, the <br />exclusive right to deal with the City on matters relatingto the redevelopment of the Redevelopment <br />Area, and the City will do nothing which is inconsistentwith that right. Redeveloper understands, <br />however, that much of the real property in the Redevelopment Area is owned by third parties and <br />that the City cannot preclude the development thereof by its owners; provided, however, the City <br />agrees to consider implementing an interim ordinance pursuant to Minnesota Statutes 462.355 as <br />necessary for the protectionof the planningphases of the RedevelopmentArea, andprovidedfurther <br />that the City reserves the right to seek the Redeveloper's written consent to modifications or <br />exclusions from this paragraph on a case-by-case basis, which the Redeveloper agrees to consider <br />and determine in its reasonable discretion and within a reasonable timeframe, and to inform the City <br />of its decision promptly in writing. <br />�� The City agrees to promptly process a11 applications relating to the <br />Redevelopment. The City shall take reasonable steps consistent with its statutory authority and <br />legislative discretion, where applicable, to initiate and complete or cause to have completed on a <br />timely basis all necessary and appropriate govemmental actions needed to redevelop the <br />RedevelopmentArea, including, but not limited to, those actions set forth in Section 11. <br />6. Phased Development. <br />(a) Redeveloper and the City acknowledge that the Redevelopment Area may be <br />redeveloped in non-contiguous phases over a number of years. The redevelopment of the <br />Redevelopment Area, including the scope, nature and location of phased redevelopment, will be <br />subj ect to such priorities as Redeveloper and the City, in their reasonable judgment, deem consistent <br />with the Master Plan and market conditions, taking into consideration the following variables: <br />timing, geographic areas withinthe Redevelopment Area; the scope of necessaryimprovements; and <br />the type of development to take place (for example, residential or commercial). <br />�� As a result of the phasedredevelopmentof the RedevelopmentArea, the City <br />anticipates that it will enter into a Redevelopment Agreement for the Redevelopment Area with <br />Redeveloper which may provide for separate Redevelopment Agreements with Redeveloper for <br />certain phases of redevelopment of the Redevelopment Area. The terms and conditions of such <br />Redevelopment Agreements shall be subject to the provisions of this Agreement and the mutual <br />agreement of Redeveloper and the City. <br />7. Redevelo�er Actions. Redeveloper shall take the following actions: <br />(a) By September 30,2004: <br />� Complete wark with an Advisory Stakeholder Task Force to be <br />appointed by the Council (to include property owners, residents, <br />neighborhood groups, business owners and developers) in formulating <br />the Implementation Plan. <br />� <br />
