<br />in any way related to activity now conducted in, on, or in any way related to the Property,
<br />unless such conditions or concerns are caused by the activities of the Lessee.
<br />b) Owner shall hold Lessee harmless and indemnify the Lessee from and assume all duties,
<br />responsibility and liability at Owner's sole cost and expense, for all duties,
<br />responsibilities, and liability (for payment of penalties, sanctions, forfeitures, losses,
<br />costs, or damages) and for responding to any action, notice, claim, order, summons,
<br />citation, directive, litigation, investigation or proceeding which is in any way related to:
<br />a) failure to comply with any environmental or industrial hygiene law, including without
<br />limitation any regulations, guidelines, standards, or policies of any governmental
<br />authorities regulating or imposing standards of liability or standards of conduct with
<br />regard to any environmental or industrial hygiene concerns or conditions as may now or
<br />at any time hereafter be in effect, unless such compliance results from conditions caused
<br />by the Lessee; and b) any environmental or industrial hygiene conditions arising out of or
<br />in any way related to the condition of the Property or activities conducted thereon, unless
<br />such environmental conditions are caused by the Lessee.
<br />15. Termination. Except as otherwise provided herein, this Lease may be terminated as
<br />follows: (a) by either party upon a default of any covenant or term hereof by the other party,
<br />which default is not cured within sixty (60) days of receipt of written notice of default to the
<br />other pa ty(without, however, limiting any other rights of the parties at law, in equity, or
<br />pursuant to any other provisions hereo�; (b) by Lessee upon 60 days written notice, if it is unable
<br />to obtain or maintain any license, permit, or other governmental approval necessary for the
<br />construction and/or operation of the Antenna Facilities or Lessee's business; (c) by Lessee upon
<br />60 days written notice, if governmental approval is denied, withdrawn, or lapsed, if soil boring
<br />tests are found to be unsatisfactory, if the site becomes technically incompatible, or, in the
<br />Lessee's sole discretion, if the site can no longer be used for its intended purposes; (d) by either
<br />party upon 30 days written notice if a structural engineer determines that the Property is
<br />structurally unsound for use as a tower, including but not limited to consideration of age of the
<br />structure, damage or destruction of all or part of the Property from any source, or factors relating
<br />to condition of the Property and Lessee is unwilling to perform or cause to be performed the
<br />appropriate structural or other modifications to be reasonably approved by the structural
<br />engineer; or (e) by either party upon 30 days written notice if the FCC determines in its sole
<br />discretion that continued occupancy of Property by Lessee is in fact a threat to health, safety or
<br />welfare.
<br />Within 90 days of written notice of termination of this Lease for any of the reasons stated in this
<br />paragraph, Lessee shall remove its equipment, personal property, Antenna Facilities, and
<br />leasehold improvements frozn the Property, and shall repair any damage to the Owner's Property
<br />caused by such equipment, normal wear and tear and casualty excepted; all at Lessee's sole cost
<br />and expense and to reasonable satisfaction of the Owner. Any such property or facilities which
<br />are not removed by the end of 90 day period shall become the property of Owner.
