Three Parcel Minor Subdivision: When <br />a subdivision creates a total of three <br />(3) or less parcels, situated in an area <br />where public utilities and street rights <br />of way to serve the proposed parcels <br />already exist in accordance with City <br />codes, and no further utility or street <br />extensions are necessary, and the <br />new parcels meet or exceed the size <br />requirements of the zoning code, the <br />applicant may apply for a minor subdi- <br />vision approval. <br />The proposed subdivision, in sketch <br />plan form, shall be submitted to the <br />City Council at a public hearing with <br />notice provided to all property owners <br />within three hundred fifty feet (350'). <br />The proposed parcels shall not cause <br />any portion of the existing lots, par- <br />cels, or existing buildings to be in <br />violation of this regulation or the zon- <br />ing code. Within thirty (30) days after <br />approval by the City Council, the ap- <br />plicant shall supply the final survey to <br />the Community Development Director <br />for review and approval. A certificate <br />of survey shall be required on all pro- <br />posed parcels. After completion of the <br />review and approval by the City Man- <br />ager, the survey shall be recorded by <br />the applicant with the Ramsey County <br />Recorder within sixty (60) days. Fail- <br />ure to record the subdivision within <br />sixty (60) days shall nullify the approv- <br />al of the subdivision. (Ord. 1171, <br />9-23-1996) <br />1104.05: PROCEDURE FOR VARIANC- <br />ES: Any applicant for a variance <br />pursuant to Section 1104.04 above shall <br />comply with the procedure for variances to <br />the zoning code as set forth in Section <br />1013.02 of this Code.
