4,� BACKGROUND: <br />4.1 Section 1102.02 (Necessary Data for Preliminary Plats) stipulates the information which <br />needs to be placed on a preliminary plat. <br />4.� Section 1102.03 (Requirements Governing Approval of PreliminaryPlats) stipulates the <br />required process for receiving preliminary plat approval. <br />�,3 Section 1102.04 (Necessary Data for Final Plat): stipulates the required information <br />necessary for approving a final plat. <br />4_� The proposal by Zawadslci Homes is the combination of four previously platted lots into <br />three legal conforming residential lots. Because four lots are involved, the preliminary <br />and final plat process is necessary versus that allowed under Section 1104.04 of the City <br />Code. <br />S.� REVIEWofREQUEST: <br />�. I The proposal by Zawadslci Homes will combine Lots 3, 4, and 5, Minnesota Realty Co's <br />Owasso and a portion of Government Lot 3 into three residential lots of similar shape and <br />size. Each new lot will have a minimum of 100 feet of frontage along West Owasso <br />Boulevard; a minimum depth of 125 feet; and a minimum of 23,000 sq. ft. <br />5. � The combination includes a portion of the adjacent Government Lot 3 into each of the <br />adjacent lots. The outcome is the need to create three new lots of record to be lcnown as <br />Lots 1, 2, and 3, Owasso Bay. <br />6�� STAFF FINDINGS: <br />b. i The City Planner has concluded that the proposal meets the requirements of the <br />Comprehensive Plan and Zoning Ordinance. <br />6. � The City Planner has concluded that the request meets the requirements of Section <br />1016.14 B(Water Management Overlay District Lot Standards). Specifically, all three <br />lots have a minimum width adj acent to Lalce Owasso of 100 feet and a minimum lot size <br />of 15,000 sq. ft. <br />�� The proposed Preliminary & Final Plat indicates the required setbacks necessary to <br />construct a home on any of the three lots. Specifically, each lot is required to have a <br />minimum front yard setbacic of 30 feet, a side yard setbacic of 10 feet and a minimum <br />setback form the Lake Owasso shoreline of 75 feet.
