REQUEST FOR CITY COUNCIL ACTION <br />DATE: OG/ 14/04 <br />ITEM NO: 3.i <br />Department Approval: � Manager Appr�vecl: r Agenda Section <br />Item Description: A request by Mark Petersen for a MINOR S U B D M S I O N o n a parcel <br />of land located at 386 WaLner Street (PF3572) <br />�.� REQUESTED ACTION <br />€. L Mark Petersen, Accord Builders, seeks approval of a MINOR SUBDIVISION in <br />accordance with Section 1104.04E to allow the creation an additional legal conforming <br />residentialparcel from the property located at 386 Wagner Street. Each parcel will meet <br />or exceed all City lot size requirements. <br />�,� BACKGROUND: <br />?. C Section 1144.04E (Three Parcel Minor Subdivision) states: When a subdivision creates a <br />total of three (3) or less parcels, situated in an area where public utilities and street rights <br />of way to serve the proposed parcels already exist in accordance with City codes, and no <br />further utility or street extensions are necessary, and the new parcels meet or exceed the <br />size requirements of the zoning code, the applicant may apply for a minor subdivision <br />approval. A City Council public hearing, with notice to property owners within 350 is <br />required. <br />�.� Section 1004.016 (ResidentialDimensional Requirements)establishes the minimumlot <br />standards for residentialparcels, which includes: an 85 foot minimum width along a <br />public right-of-way; a 110 foot minimum depth; and 11,004 minimum square feet. <br />?. � Section 1103.06A reads: the minimum lot dimensions in subdivisions designed for single <br />family detached dwelling developments shall be: (1) 85 feet wide at the established <br />building setback line and on outside curvatures. <br />'�.� Section 1103.06�' states: Side lot lines shall be substantially at right angles or radial to the <br />street line. <br />?. � The parcel at 3 86 Wagner Street lies directly north of Ramsey County Open Space <br />referred to as Woodview Marsh. The parcel is located in Comprehensive Planning <br />District 15, where it is designated as low density residential, LR and is zoned R-1, Single <br />Family Residential District. <br />�.� The existing parcel addressed at 386 Wagner Street has a depth of 150 feet, a length of <br />266 feet, and lies adjacent to the Western Avenue cul-de-sac and the Wagner Street cul- <br />de-sac. A roadway easement of 60 feet lies between 386 Wagner Street and 403 Wagner <br />Street and 1823 Western Avenue. <br />PF3572_RCA 061404 Page 1 of 3 <br />
