�,'� No new street or utility construction is necessary to serve the proposed division. Sewer <br />and water laterals and utility easements are necessary for the vacant developable parcel <br />and a new driveway access on to Asbury Avenue will need to be approved by the <br />Roseville Public Worlcs Department. <br />�,� Should the request be approved by the City Council, the staff, prior to the applicant's <br />recording with the Ramsey County Recorder, must review a certificate of survey and a <br />quit claim deed for compliance with the Council's approval. <br />�.� STAFF FINDINGS & CONDITIONS: <br />3. f In review of the Roseville City Code, the City Planner has concluded that the adiustment <br />in propertv line from its existin¢, location to the proposed location falls under a <br />"RECOMBINATION under Section 1104.04B and not a"THREE PARCEL MINOR <br />SUBDIVISION" as noticed to the public. <br />�, � In February of 2004 Mr. Albertson applied for a VARIANCE and MINOR <br />SUBDIVISION, seeking approval to create a substandardparcel width. On April 7,2004 <br />the Planning Commission held the public hearing requiring the request and unanimously <br />recommended denial, which action lead to the subsequent withdrawal of the request by <br />Mr. Albertson. During the Planning Commission's hearing, staff indicated to the <br />residents that should Mr. Albertson desire to divide the parcel in a manner that meets the <br />City Code, the process would be forwarded to the Council and the neighborhoodwou�d <br />be notified of the legal lot line adjustment. <br />�,� The City Planner has concluded that the proposal meets the requirements of the <br />Comprehensive Plan and Zoning Ordinance. <br />�. �} The City Planner has concluded that the request meets the requirements of Section <br />1004.016 (Residential Dimensional Requirements), Section 1103.06A1 and Section <br />11.0406F of the Roseville City Code. Specifically, both parcels have a minimum width <br />of 85 feet, a depth of 110 feet and a minimum of 11,000 sq. ft. Parcel "B" although <br />uniquely designed) has a minimum width of 85 feet at the established 30 foot front yard <br />setbacic. Parcel "B" has lot lines at substantial right angles to the street line. <br />�.� The City policy is to accept parlc land or cash in lieu of land dedication for the creation of <br />new lots. However, Mr. Albertson is not creatin�, a new lot, but rather adjusting the <br />existing line. No parlc land dedication is required for this change in lot design. <br />�.� The City policy is to accept a Sewer AvailabilityCharge (SAC) upon the issuance of a <br />building permit.
