City Council Regular Meeting — 05/24/04 <br />DRAFT Minutes - Page 14 <br />so small, and that all the rest of the requirements of Chapter 11 <br />regarding plat procedures and platting were not always <br />necessary, and requirements for preliminary and final plat <br />approval would be applicable to new subdivisions, rather than a <br />parcel such as this one under discussion. <br />Mayor Klausing recommended, that if tonight's action were to <br />hear this item at a future meeting, this discussion would be more <br />appropriate at that time. Mayor Klausing sought Council <br />consensus on notification of the public regarding reconsideration <br />of this item. <br />Councilmember Schroeder concurred that public notice should <br />be provided. <br />Councilmember Maschka opined that, given the current <br />ordinance language, his interpretation was that the minor <br />subdivision at 3103 Asbury represented a legal lot under City <br />Code, and the Council had no option but to approve the request. <br />Councilmember Maschka noted that in fairness to the applicant, <br />he would prefer to take action tonight, but merits of the argument <br />for public notice were appropriate, and he would concede <br />delaying action until the June 14, 2004 Council meeting. <br />Maschka moved, Kough seconded, the addition on the June 14, <br />2004 Council agenda, consideration of rescinding previous <br />Council action; and consideration of granting a two-lot minor <br />subdivision of property at 3103 Asbury (PF 3556); with staff <br />instructed to provide published notice, as well as mailed notice to <br />all residents within 350' of the property, with said notice clearly <br />defined stating the Council's intent to reconsider and possibly <br />rescind their previous action of denial. <br />City Attorney Anderson noted the procedural aspects of this <br />motion related to Roberts Rules of Order, in considering the <br />rescinding of earlier motion of denial made on May 10, 2004 at <br />the regular Council meeting, prior to any action to consider <br />approval of the two-lot minor subdivision. Mr. Anderson further <br />noted that no notice was required to consider rescinding previous <br />action and could be approved on a 2/3 vote; but that if notice <br />were provided verbally or in writing, a simple majority vote <br />
