City Council Regular Meeting — 06/14/04 <br />Minutes - Page 16 <br />his venture. <br />The applicant noted that he had formerly been the General <br />Manager at the Ground Round Restaurant in West St. Paul, and <br />had never had any compliance issues at that facility; and <br />anticipated opening by July 5, 2004. <br />Mayor Klausing opened and closed the Public Hearing at 8:12 <br />p.m. with no one appearing for or against. <br />Maschka moved, Kough seconded, approval of the application <br />for an On-Sale Intoxicating Liquor License for the Backyard Bar <br />& Grill, located at 2100 Snelling Avenue for the period of June <br />14, 2004 through December 31, 2004; pending final review and <br />approval by the City Attorney. <br />Roll Call <br />Ayes: Schroeder, Maschka, Ihlan, Kough and Klausing. <br />Nays: None. <br />9. Consider a Two Lot Minor Subdivision of Property Owned <br />by Vernon Albertson at 3103 Asbury (PF 3556); Possible <br />Rescission of Prior Council Action <br />City Planner Thomas Paschke briefly reviewed the background <br />of this request; previous staff recommendations for approval; and <br />past Council action denying the request. <br />Mayor Klausing requested City Planner Paschke's review of <br />minimum lot requirements and setbacks. <br />City Attorney Anderson counseled Councilmembers regarding <br />procedural language to be used in reconsideration of a majority <br />vote to rescind prior actions. <br />Mayor Klausing reviewed previous action; noting that the <br />Council action to approve the request had failed on a vote of 1-2, <br />with Councilmember Kough voting Yes and Councilmembers <br />Ihlan and Schroeder voting No.. <br />City Planner Paschke reviewed the May 10, 2004 staff report, <br />specifically Item 2.2 defining Section 1103.06A language <br />Consider a Two Lot <br />Minor Subdivision <br />of Property Owned <br />by Vernon <br />Albertson at 3103 <br />Asbury (PF 3556); <br />Possible Rescission <br />of Prior Council <br />Action <br />
