City Council Regular Meeting — 06/14/04 Minutes - Page 17 regarding minimum lot dimensions of eighty-five feet (85') for building setback. Councilmember Klausing recognized the applicant, Mr. Albertson, and his attorney. Daniel G. Wall, Attorney with the law firm of Greenstein, Mabley & Wall, LLC, representing the Albertsons (applicant) Mr. Wall expressed appreciation to the City Council for their reconsideration of previous action; opining that a decision to approve this Minor Subdivision would serve to benefit the City. Mr. Wall reviewed his May 19, 2004 letter to the City Council and his interpretation of the City Council's quasi judicial role in granting this request; and specifically requesting the removal of several of the conditions recommended by staff (i.e., 3.8, 3.9 and 3.10) with special emphasis on the removal of 3.8 to eliminate future sale of the properties without hindrances imposed. Mayor Klausing opened the meeting for public comment on this issue at 8:28 p.m. John Kysylyczyn, 3083 N. Victoria Street Mr. Kysylyczyn expressed concern related to his perception of an ongoing ethics issue; as well as the land use issue related to this request. Mr. Kysylyczyn alleged conflict of interest issues for Councilmembers Ihlan and Maschka, as well as Mayor Klausing as recipients of campaign contributions from the Albertson's attorney, Mr. Wall; opining that while their voting on this issue may not be illegal, it was unethical. Councilmember Ihlan requested a Point of Order, which was recognized by the Chair; with Councilmember Ihlan noting that these comments were not relevant to the business before the City Council. Mayor Klausing concurred with Councilmember Ihlan's Point of Order, recognizing that Mr. Kysylyczyn had made his point, and requested that he move on to his discussion related to land use concerns.
