City Council Regular Meeting — 06/14/04 <br />Minutes - Page 17 <br />regarding minimum lot dimensions of eighty-five feet (85') for <br />building setback. <br />Councilmember Klausing recognized the applicant, Mr. <br />Albertson, and his attorney. <br />Daniel G. Wall, Attorney with the law firm of Greenstein, <br />Mabley & Wall, LLC, representing the Albertsons <br />(applicant) <br />Mr. Wall expressed appreciation to the City Council for their <br />reconsideration of previous action; opining that a decision to <br />approve this Minor Subdivision would serve to benefit the City. <br />Mr. Wall reviewed his May 19, 2004 letter to the City Council <br />and his interpretation of the City Council's quasi judicial role in <br />granting this request; and specifically requesting the removal of <br />several of the conditions recommended by staff (i.e., 3.8, 3.9 and <br />3.10) with special emphasis on the removal of 3.8 to eliminate <br />future sale of the properties without hindrances imposed. <br />Mayor Klausing opened the meeting for public comment on this <br />issue at 8:28 p.m. <br />John Kysylyczyn, 3083 N. Victoria Street <br />Mr. Kysylyczyn expressed concern related to his perception of <br />an ongoing ethics issue; as well as the land use issue related to <br />this request. Mr. Kysylyczyn alleged conflict of interest issues <br />for Councilmembers Ihlan and Maschka, as well as Mayor <br />Klausing as recipients of campaign contributions from the <br />Albertson's attorney, Mr. Wall; opining that while their voting <br />on this issue may not be illegal, it was unethical. <br />Councilmember Ihlan requested a Point of Order, which was <br />recognized by the Chair; with Councilmember Ihlan noting that <br />these comments were not relevant to the business before the City <br />Council. <br />Mayor Klausing concurred with Councilmember Ihlan's Point of <br />Order, recognizing that Mr. Kysylyczyn had made his point, and <br />requested that he move on to his discussion related to land use <br />concerns. <br />
