Extract of Draft Minutes, Planning Commission Meeting of July 7,2004: <br />2 <br />3 a. Planning File 3581: Request by Yanyun Lin for a Street Right-of-way <br />4 Vacation for a portion of Huron Avenue directly adjacent to 1866 Huron <br />5 Avenue. <br />6 <br />7 Chair Mulder opened the hearing and requested City Planner Thomas Paschke to present <br />8 the verbal summary of the staff report dated July 7,2004. <br />9 <br />10 Thomas Paschke explained that the proposal was to vacate the eastern 30 foot by 30 foot <br />11 dedicated public right-of-way, which right-of-way has been reviewed by the Public <br />12 Works Department and determined to be unnecessary. Specifically, Huron Avenue, at <br />13 this location, has been constructed within a 60 foot wide (east to west) right-of-way. It is <br />14 adequate to support the necessary public infrastructure. <br />15 <br />16 In review of the lots along the east of Huron Avenue, Mr. Lin's lot and the lot at 1867 <br />17 Huron Avenue are the only lots along Huron Avenue that include this unnecessary right- <br />18 of-way. It should also be noted that 1866 and 1867 Dellwood Avenue have a similar <br />19 situation. <br />20 <br />21 Staff recommended approval. <br />22 <br />23 Member Traynor asked if there was a right-of-way vacation standard for review. Thomas <br />24 Paschke explained the process included review of city plans and capacities, and approval <br />25 by the City Public Works Department regarding public needs for the right-of-way or <br />26 easement. The parcel was determined not needed for right-of-way or utilities. <br />27 <br />28 <br />29 <br />30 <br />31 <br />Mr. Lin had no further comments. <br />Chair Mulder closed the hearing. <br />32 Motion: Member Bakeman moved, seconded by Member Traynor, to approve the <br />33 request of Yayun Lin to vacate a 30 foot by 30 foot portion of Huron Avenue directly <br />34 adj acent to 1866 Huron Avenue, based on the findings of Section 5 of the proj ect report <br />35 dated July 7,2004, subject to the submission of a legal description for recording. <br />36 <br />37 Ayes: 6 <br />38 Nays: 0 <br />39 Motion carried. <br />40 <br />
