Employee Riphts Preserved. An cmployee who consents to work in a setting <br />whore an employer allows srnoking does not waivc or othcrwise suYrcnder any legal rights thc <br />empioyee mxy have against the employer or any othcr party. <br />SECTION VII. Enforeement: <br />A. Misdem�xnor. Any person who violates thia t�rdinancc, or who shall permit such a <br />violation to exist on the premises undear their control, or who shall fail to take action to <br />abate the �xistence of the violation within the ap�cified time peribd when order�d or <br />notified to do sa by �he Department, shall be guilty of a ntiedemeanor, and upon conviction <br />thereof shall be purished thereforc, as provided by law. A separxte of�'ense shall ba <br />deemed committed upon �aeh day during ar on whieh a violation occuzs or eontinucs. <br />B. Equitable Relief. In the event of a violation or a threat of violatian of this ordinance, the <br />County Attamey may takc appropriate action to Enforce this otd�nance, including <br />applicatian for injunctive relief, action to compel performancc, or other appropriata action <br />in court, if necessary, to prevent, restrain, correct, or abate such violations or threat�ned <br />violations. <br />C. Penalt�es. Failure ta comply with this ordinance shall lx a basis for adverse action undcr <br />Minnesata Statutes, socti0n 340A.415. <br />D. Citations. When�ver any representative of the Departmant discovcrs a violation af this <br />ordiaance, a citation may be issued to the person alleged to have committed the vi�lation. <br />The cita�ion shall be issued to the person chazged with the viol�tion, or in thc case of a <br />corporation ar municipality, to any officer or agent expressly or impliedly authorized to <br />acccpt such issuance. <br />168 SECTIO� VIII.
