<br />Subsection S. Other PerSOn in Charge �+� che agent of the Proprietor authorized to
<br />pa�form administrativedirection to, and general sup�rvieion of, the activities within a Licensed
<br />Liquor Establishment, Food Establishment,Bowling Alley, or Pool H�71 at any given time.
<br />Subsection�5. Pool �tiall meaazs acommercial pool hall or bi�liard h�ll.
<br />Subsection 6. Proprietor means the party who ultimately controls, govarns, or directs the
<br />activities within the Licensed Liquor Establishment, Food Establishment, Bowling Alley, �rr
<br />Pool Hall. A Proprietor m�y be a corporation or a natural person.
<br />Subsection 7. Smol�ng means i.nl�ling, exhaling, ar combustion of any cigar, cigarette, pipe,
<br />tobacco product, we.�d, plant or any other similar article. gmlcing includes possessing or,
<br />carrying a lighted cigar, cigarette, pipe or any other smking mat�rial. SI[rokir�g does not
<br />incIudc the ust of tobacco by an enrolled mar�ber of a federally recognized Indian tribe as part
<br />of a traditional Indian spiritual or cultural ceremony.
<br />SECTION IV. Pr�ohi�idons:
<br />Subseetion 1, S�king Prohibited. Smoking is prohibited in Licensed Liquor
<br />Establishments, Food Establishments, Bowling Alleys, and Pool ��.This prohibition does
<br />not apply to guest roaY�s of a hotel or motcl or outdoor spaces.
<br />Subsection 2 Right to Prohibit Smoking. Nothing in tllis ordinance prevents the Proprietor
<br />or Other Person in Charge of any place, including, but not limited to any outdoor space, fran
<br />prohibiting Smoking m any such place.
<br />Subsection 3. Compliance with Minnesota Cttan Indoor Air Act. This ordinance is
<br />intended to complement the Minnesota Clean Indoor Air Act, Minnesota Statutes, sections
<br />144.411 to 144.417, as amended fr�'i time to time. Nothing in this ordinance authorizes
<br />groking in any location where Sinoking i s prohibited or restricted by other ].ans,
<br />SECTION V. �
<br />S�bs�ticm 1. The Proprietor shall post "No Smoking" R.� C that comply witll the Minnesota
<br />Clean Air Act Rules, MinnesotaRules, part 4620.0500, as amerxled frtm timc to time.
<br />Subsection 2. The Proprietor or Other Ppxscn in Charge shall ensure that ashtrays, lighters,
<br />and nat�ct�ods are mt provided in ar�as where Smoking is prohibited,
<br />Subsection 3, The Proprietor or Other Person in Charge, shall ask any person who smokes �n
<br />�.rf area where Smoking is grohibit�d to refrain From Smoking and, if the person does not
<br />refrain fran �mofcing afterbeing askcd to do so, shall ask the person to le�ve.
