'Ihe prohibitions of subsection 1 do not apply to the following <br />pl�ces or situafions: <br />A. Bars, including those that are immediately adjacent to a Restaursat, provided that the <br />following conditions at� met: <br />1. <br />2. <br />3. <br />4, <br />The Bar is separated from the Restaurant on 8�] sid�s by continuous floor-to-ceiling <br />walis, which are interrupted only by closeable doors, that are eontint�ously closed, <br />except whcn a pexsal is actively entenng or exiting thb Bar; and <br />The ventilation syS�GaYS for the Bd�' � totally separated from those for tht <br />Restaurant, with the �' *+�-�*�+�+m � a negative air pressure in relation to the <br />adjacentRestxur�nt; and <br />Whoso reverxaes from ti�e sale of food in this portion of the Restaurant are <br />consistent with the dckinition in this ordinance; and <br />Consistent with Minnesota Statutes, section 340A.503, subd, 4(b), the Bar dots not <br />permit entranceor employmentof rttinoz� at any time; and <br />B. Restaurants that are closed to the public while being used for a private function. <br />C. Private Clubs, except whe� they are open to serve food artdlor beverage to the public <br />who arc not members.'For purposes of this ordinance. persons accompanied by <br />m�ibers arc considered to be memb�rs, <br />D. An cvent that includes licensed food andlor beverage service in any rnunicip�l owned <br />and maa�gt�d building, when the municipal governingbody has�declared specific <br />p�rtions of the building to � exempt for the ev4nt. <br />Subsection 3, Right to Prohibit Smakin�. Nothing in this ordinance prevents the Proprietor <br />or Other Person in Charge of any Establishment, including, but not limited to any outdoor <br />space, from prohibiting S�noking in any such Eatablishment. <br />Subsection 4� CompiiAnct with Minnesota Clean Indoor Air Act.
