The Proprietor shall post "No Smoking" si�s that comply with t,ha Minnesota <br />�l�an Air Act Rules, Minnesota Rules, part 4620.0500, as amended from tare to time, <br />Subsection 2 The Proprietoror Other Person in Charge shall ensure that ashtrays, lighters, <br />and matchbooks arc not provided in �eas wherc Smoking is prohibitcd <br />Subaection 3. The Proprietor or Other Person in Charge, shall ask any person who smokes in <br />� area where Smoking is prohibited to refrain fran Smoking and, if the person does not <br />rcfrain fzan Smoking after bcing a,skal to do so, shall �ak the person to leave. <br />Subsection 4. Records required for exemption, <br />A. Establishments chiming exemption pursuant to Section IV, Subsection 2 of this <br />Ordinance, shall provide a copy of the annual report of food and liquor sales records <br />as provided to State Revenue Authorities from the most recent liquor licensing yeftr. <br />Thc rcport sY�all be submitted in a form d�tcmuncd by the Degartmen� and shall be <br />submitted no later than [date]. Information related to the exemption shall be provided <br />under oath �nd penalty of perjury. The report and accompanying form shall be the <br />basis for demonstrating whether or not the eatablishment continues to � cl�g[bl� for <br />the requirements of sectirn IV. <br />B. Persons serekiru,� to open an Establishmentexempt fran the requirements of Section I'V <br />of this ordinance, shall parovide a notariud affidavit and agreement to the Department <br />at the saare time � they submit their initial food license application to the licensing <br />authority. The affidavit and agreement, in a form to be approved by the Department, <br />must demonstrata that their business plan projections indicate that ihey are eligible tor <br />SuCh an exemption. Such persons must alSO agt�e to convert to a smoke- freestatus if <br />their reeords indicate, after six Calendar months of operation, that the business is not <br />eligible for continued exemption f�o� fhe smoke-ftu requirements of this ordinance. <br />�E{.'I'l��+T VI. Ernolovee �dF��,��: <br />Subsection ]. No Retaliation. No person or employer shall discharge, refuse to hire, refuse to <br />serve or in any manner rotaliate against any employee, applicant for employment, or customer <br />beeause such employee, applicant, or customer exercises any ri$ht to a smake-free <br />environmerrt afforded by this ordinance or other law. <br />Subsection 2 Employee Rights Pre��t�ed, An employee who consents to war�k in a setting <br />where an employer allows smoking does not waive or a�herwise sutx+ender any lcga] rights the <br />empIoyee may have against the employer or any other party. <br />SECTION �� <br />��7 A, Misdemeanor.
