EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the ��'� day of August 2004, at 6:30 p.m. <br />The following members were present: <br />and the following were absent: <br />Council Member introduced the following resolution and moved its adoption: <br />RESOLUTION NO. <br />A RESOLUTION APPROVINGA CONDITIONAL USE PERMIT <br />FOR SPEEDWAY SUPERAMERICA, 2380 COUNTY ROAD D T O ALLOW 91 SQ. FT. <br />OF EXTERIOR SEASONAL MERCHANDISE DISPLAY & STORAGE (PF3588). <br />WHEREAS, Speedway SuperAmerica has requested a Conditional Use Permit to allow <br />the display of outdoor seasonal merchandise at their fuel and convenience store at 2380 County <br />Road D; and <br />WHEREAS, Speedway SuperAmerice at 2380 County Road D is legally described at as: <br />Lot 1, Block 1, J's Addition <br />Pl�D # OS-29-23-21-0085 <br />WHEREAS, Speedway SuperAmerica seeks to display seasonal merchandise on the <br />premises, including soda pop/beverage, auto/engine fluids, windshield washer fluid, charcoal, <br />wood, water softener pellets, and/or mulch; and <br />WHEREAS, said outdoor seasonal display of inerchandise is allowed through the <br />Conditional Use Permit process per Section 110.09 and 1005.015 of the Roseville City Code; <br />and <br />WHEREAS, the Roseville Planning Commission held a public hearing regarding the <br />Conditional Use Permit request for Speedway �uperAmerica at 2380 County Road D and voted <br />(6-0) to recommend approval of the request, based on the findings of Section 6.4 and 6.5 of the <br />projectreportdated August 4,2004 and subjectto 7 conditions; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to grant <br />Speedway SuperAmerica, 23 80 County Road D, a CONDITIONAL USE PERMIT consistent <br />with Section 1013 of the Roseville City Code based on the findings in Section 6.4 and 6.5 of the <br />project report dated August 23,2004, and subject to the following conditions: <br />1. The seasonal merchandise display area shall be limited to 91 sq. ft. (2% of <br />structure footprint) and shall be no greater than 3 feet in width from the front <br />(north) building wall, no higher than 4 feet, and shall not block windows or the <br />
