4.0 BACKGROUND: <br />�.1 On November 2, 1939, Rolling Green was recorded with Ramsey County. This <br />subdivision plat created lots and dedicated street right-of-way for an area generally west <br />of Chandler Avenue, south of McCarrons Boulevard, and north of Wagner Street. <br />Specific to this plat was a 30 foot wide dedication for the future roadway to be known as <br />Wagner Street. <br />�.� On July 2, 1980, a roadway easement was granted to the City of Roseville, which <br />easement is 30 feet wide, 266 feet long, and directly adjacent to 386 Wagner Street. <br />+�_� On May 6, 1992, a roadway easement for a portion of the Western Avenue cul-de-sac was <br />granted to the City of Roseville. <br />�.� Judith LeTendre, property owner at 386 Wagner Street, has requested that a portion of the <br />30 foot by 266 feet easement be vacated. Specifically, a portion 30 feet by 153 feet as <br />confirmed by the Public Works Department. <br />�_U STAFF FINDINGS: <br />S_ 1 The proposal to vacate the southern portion of the 3 0 foot by 266 foot roadway easement <br />has been reviewed by the Public Works Department. The roadway easement has been <br />determined to be unnecessary. Specifically, Wagner Street will remain a dead end cul-de- <br />sac west of Western Avenue (never to connect) and the easement has no public utilities <br />beneath or above it. <br />�.� STAFF COMMENT & RECOMMENDATION: <br />�i_ L Based on the determination of the Public Works Department that a portion of the <br />previously granted roadway easement is no longer necessary for public infrastructure, the <br />City Planner recommends approval of the ROADWAY EASEMENT VACATION <br />request by Judith LeTendre. <br />�.0 PLANNING COMMISSION ACTION: <br />�, L On August 4, 2004 the Roseville Planning Commission held the public hearing regarding <br />the LeTendre road right-of-way vacation request. At the meeting adjacent property <br />owners addressed the Commission. Specifically, they sought answers to questions: What <br />is being vacated?, Can the other side of the "road" be vacated?, Where can a home be <br />placed on the new parcel?, What are the setbacks based on the proposed right-of-way <br />vacation? <br />�_� The City Planner indicated to the adj acent property owners that the road right-of-way to <br />be vacated is separate from the north 30 feet; that the City would consider vacating the <br />roadway portion of the north 3 0 feet, but would need to retain a portion of the area for the <br />PF3592_RCA_082304.doc Page 2 of 3 <br />
