underground public utilities; and that a home on the newly created parcel (Minor <br />Subdivision approval 6/14/04) could be placed 30 feet from the northeast property line <br />adjacent to Western Avenue cul-de-sac,10 feet from the west and north property line, and <br />a minimum of 50 feet from the delineated wetland (south). The placement of a home <br />would change after the 30 wide by 153 foot long portion of Wagner Street is vacated, in <br />essence allowing a principal structure 3 0 feet closer than previously noted. <br />7.3 The Planning Commission voted (6-0) to recommend approval of the vacation of a 3 0 <br />foot by 153 foot portion of Wagner Street right-of-way, based on the findings in Section 5 <br />and condition of Section 6 of the project report dated August4, 2004. <br />8.0 SUGGESTED CITY COUNCIL ACTION: <br />8.1 ADOPT a RESOLUTION GRANTING APPROVAL of the VACATION of a 30 <br />FOOT by 153 FOOT PORTION of the WAGNER STREET ROADWAY <br />EASEMENT directly adj acent to 3 86 Wagner Street, based on the finding of Section 5 of <br />the proj ect report dated August 23, 2004, and subj ect to the following condition: <br />a.
