CIT'Y of ROSEVILLE <br />PLANNED UNIT DEVELOPMENT <br />AGREEMENT # <br />� <br />� <br />�� <br />� <br />This PLANNED UNIT DEVELOPMENT AGREEMENT, dated September 13,2004, is <br />entered into between the City of Roseville, a Minnesota municipal corporation, of 2660 Civic <br />Center Drive, Roseville, Minnesota 55113 ("CITY"), and UnitedProperties, 3500 West 80�' <br />Street, Minneapolis, MN 55431 ("DEVELOPER"). <br />1.0 <br />2.0 <br />EFFECTIVE DATE of AGREEMENT: <br />This agreement shall be effective upon completion of all of the following: <br />1.1 Passage and recording of The Villas at Midland Hills. <br />1.2 Passage and publication of Ordinance # (rezoning of property to PUD). <br />1.3 <br />1.4 <br />1.5 <br />Publication of the ordinance in the Roseville Review, the CITY's official <br />newspaper. <br />Execution of this agreement by the CITY and the DEVELOPER. <br />Recording of this agreement �ith Rarnsey County. <br />REQUEST for PUD APPROVAL: <br />The DEVELOPER has requested that the CITY approve a Planned Unit Development <br />(PUD) (PF#3471) that develop a 3.15 acre parcel at the northeast comer of Fulham <br />Street and Roselawn Avenue into a 33 unit condominium. The subject property is <br />legally described as: <br />Lot 1, Block 1, The Villas at Midland Hills <br />3.0 PUD APPROVAL: <br />The CITY hereby grants approval of the Planned Unit Development (identified as <br />Exhibits A through L in Section 4.0 of this Agreement), subj ect to the DEVELOPER's <br />compliance with the terms and conditions of this Agreement. The City agrees to approve <br />applications for building permits after the effective date of this agreement, if said <br />applications are consistentwith the plans identified in Section 4.0 below. <br />For any improvements proposed thereafter, notwithstanding anything in this Agreement to <br />the contrary, the CITY may require compliance with any amendments to its <br />Comprehensive Guide Plan, official controls, platting or dedication requirements enacted <br />after the date of this Agreement. <br />
