Draft (October 18,2004) <br />CITY OF ROSEVILLE <br />SUBDIVISION AND PUBLIC IMPROVEMENT CONTRACT <br />THE VILLAS AT MIDLAND HILLS <br />AGREEMENT, dated , 2004, is entered into between the CITY OF ROSEVILLE, <br />a Minnesota municipal corporation, of 2660 Civic Center Drive, Roseville, Minnesota 55113 <br />("CITY"), and United Properties Investments LLC, a Minnesota limited liability company, 3500 <br />American Boulevard West, Suite 200, Minneapolis, Minnesota 55431 ("DEVELOPER"). <br />1. Reauest for Plat approval. The DEVELOPER has asked the CITY to approve a plat of <br />land to be known as THE VILLAS AT MIDLAND HILLS (also referred to in this <br />contract as the "PLAT"). The land is legally described as follows: <br />Lot 1, Block 1, The Villas at Midland Hills <br />2. P.U.D. Approval. The CITY has approved the Planned Unit Development in PUD <br />agreement # 1311 dated �� l3/04. <br />3. Conditions of PLAT Approval. <br />A. Non-vehicular transportation corridors: All concrete sidewalks shall be a <br />minimum of 6-ft wide. All bituminous pathways shall be a minimum of 8-ft <br />wide. An easement shall be dedicated on the final plan for all pedestrian ways <br />not located within a public right- of- way. <br />B. Fulham Lift Station Improvements: The existing lift station located on the <br />west side of Fulham Street is proposed to be relocated on the east side of the <br />street. The City of Roseville would participate in the reconstruction of this <br />facility up to $25,000. The City's cost participation would be limited to the <br />degradation cost to replace the existing lift station pumps. All costs <br />associated with the relocation and increase in the capacity of the l�ft station <br />will be the responsibility of the DEVELOPER. These costs include but are <br />not limited to relocated forcemain, relocated services, relocated pipes, <br />aesthetic enhancements, increased pump capacity, and enlarged wet well <br />construction. The DEVELOPER is also responsible for the construction of a <br />12 foot wide by 70 feet long service driveway for maintenance of this lift <br />station. This driveway shall be constructed to meet a 7 ton roadway design, <br />(1.5" wear course/1.5" base course /6" of class 5).
