From <br />� Timothy Callaghan <br />� � 3062 Shorewood Lane <br />Roseville, Minn 55113 <br />T� <br />Chairman and Members of the Planning Commission <br />Dennis Welseh <br />In reviewing the Roseville <br />SHORELAND, WETLAND AND STORM WATER MANAGEMENT <br />(CHAPTER 101� <br />ordinance, I found that there were several ways in which this project deviates from the <br />ordinance. <br />First, this ordinance applies to the shoreland management district which is defined as: <br />� SHORELAND MANAGEMENT DISTRICT; Land located within three hundred feet <br />��"� �rom the ordinary high water level; or the first tier of riparian lots or the �irst f�e� �f <br />lots or the first tier of lots beyond a publicstreet when the street is <br />adj acent to a public water body, whichever is greater, �� �erta�n publ�� <br />waters as established by the City Council as established by this code. <br />As this proposed PUD is treated in Roseville as a single lot, I believe that this applies to the <br />entire property which would then be treated as the first tier of lots adjacent to the lake. At a <br />minimum, it applies to the firstthree hundred feet from the ordinary high water mark of the lake. <br />Section 1016.24 gives the requirements for a planned unit development. It defines in section � <br />and F the base density requirements which have to do with the maximum floor area coverage <br />allowed. <br />It states: <br />E. Residential PUD Base Density Evaluation: The suitable area wiEhin �f� tier of lots adjacent <br />to a MnDNR shoreland or City classified lake shall meet or exceed Ehe suitability analyses herein <br />and the City's design criteria. <br />1. The maximum floor area coverage of the site shall be thirty percent (30%) for any residential <br />PUD within the overlay district. <br />2, i��lu��n� �xh chistin� and gro�s�d units and sites, the inside building area sit�s need not <br />include decks, patios, stoops, steps, accessory structures, pr gorches and basements, ���� ��� <br />are habitable space, <br />F. Commercial PUD Base Density Evaluation: <br />1. The floor asea percent coverage of the site shall not exceed thirty percent (30%)for any <br />commercial planned unit development within the overlay district. <br />
