d) The "Commencement Date" shall be the date on which Lessee requires <br />entry onto the Properiy to commence installation of the Antenna <br />Facilities described in Paragraph 5 below. <br />3. Rent. <br />a) On the Commencement Date, the Lessee shall pay Owner, as rent, the <br />sum of Eight Thousand Three Hundred Thiriy-two and No/ 100 Dollars <br />($8,332.00) based upon Lessee's installation as shown on E�ibit B. <br />The rent for the second 120 day term sha11 be Eight Thousand Three <br />Hundred Thirty-two and No/100 Dollars ($8,332.00), payable on the <br />first day of the second term. Should the parties enter into another lease <br />regarding the City's property at 2510 North Fairview during either the <br />initial lease term or any second term, the City agrees to apply on a pro <br />rata basis any lease payments received for the voided or superseded lease <br />term to payments due under the successor lease. If Airtouch terminates <br />this lease during the initial or second term for any reason other than to <br />enter into another lease agreement with the City regarding the leased <br />premises, the City shall not be obligated to return any portion of the <br />lease payments. <br />b) Lessee may not add additional equipment and/or antennas from that <br />shown in E�ibit B without approval of Owner and an addendum <br />agreement for additional rent. <br />3. Property Use. Lessee may use the properiy for the installation, operation, and <br />maintenance of facilities for the transmission and reception of radio <br />communication signals in such frequencies as may be assigned to Lessee by the <br />Federal Communications Commission (the "FCC") and for the storage or <br />related equipment in accordance with the terms of this Lease. This use shall be <br />non-exclusive. Lessee shall use the property in compliance with all federal, <br />state, and local laws and regulations. Owner agrees to reasonably cooperate <br />with Lessee in obtaining, at Lessee's expense, any federal licenses and permits <br />required for Lessees use of the property. <br />5. Installation of Equipment and Leasehold Improvements. <br />a) Lessee shall have the right, at its sole cost and expense, to erect, install, <br />operate, and maintain in accordance with good engineering practices, <br />with a11 applicable FCC rules and regulations, on the property, the <br />necessary tower, equipment, personal property, and facilities which <br />include radio transmitting and receiving antennas not to exceed that <br />designated in E�ibit B(the "Antenna Facilities"). <br />8383] 2 <br />
