LEASE AGREEMENT <br />This Lease Agreement ("Lease") is entered into this day of January, 2000, by <br />and between the City of Roseville, a Minnesota municipal corporation ("Owner") and Airtouch <br />Cellular, a corporation ("Airtouch"), with local offices at Westwood Lake Office <br />Park, 8401 Wayzata Blvd. Suite 110, St. Louis Park, MN 55426 ("Leasee"). <br />In consideration of the terms and conditions of this Agreement, the parties agree as <br />follows: <br />Leased Premises. Owner hereby leases to Lessee a portion of the property <br />located at 25 10 North Fairview Avenue, Roseville, Minnesota 55 113, and <br />legally described on E�ibit A The City's land shall be referred to as <br />"Owner's Properiy" or "the properiy". The property interest leased and <br />granted by the Owner are the following: <br />Ground space comprised of appro�mately 2,500 (50 x 50) usable square feet, <br />exact amount to be fixed by parties and described on E�ibit A, non-exclusive <br />easements required to run utility lines and cables, non-exclusive easement across <br />Owner's Property for access. <br />No other space or property interests are being leased to the Lessee except as <br />described as above and as described on Exhibit A. <br />2. Term/Renewals. <br />a) The term of this lease shall be 120 days beginning on the <br />"Commencement Date" (as hereafter defined) and subject to the terms of <br />Paragraph 13. <br />b) Lessee shall have the right to extend this lease for one additional 120 day <br />term subj ect to (c) below; <br />c) This Lease shall automatically be renewed for one renewal term unless <br />one of the following events occurs: (1) Lessee notifies the Owner of its <br />intention not to renew the Lease at least sixty (60) days prior to the <br />expiration of the 120 day term; or (2) Lessee is in default of any of the <br />terms or conditions of the Lease. <br />8383 I <br />
