Purpose <br />The purpose of this Agreement is to allow and define a procedure for the Cities to <br />provide automatic first-alarm response for structure fires within one another's <br />jurisdictional boundaries. <br />II. Procedures <br />Each City will provide to the other an engine company (with a minimum crew of <br />four (4) non-probationary firefighters, trained to meet or exceed the State of <br />Minnesota Firefighter I certification) to respond on a first-alarm basis to structure <br />fires. <br />Each City will provide mutually agreed upon equipment to respond for first-alarm <br />structures, to mutually agreed upon response districts, during mutually agreed <br />upon hours. The equipment to respond, response districts, and hours that <br />automatic aid will be provided will be outlined in the documents attached hereto, <br />each labeled respectively to the community receiving and giving aid. <br />The ranking officer (or his/her designee) of the City in which the incident occurs <br />shall serve as the Incident Commander and shall be in command of all personnel <br />and equipment operating on the emergency scene. <br />Each participant to this agreement shall continue to be responsible for its own <br />personnel, equipment, and for injuries or death to any such personnel or damage <br />to any such equipment. Each participant's personnel shall be deemed to be <br />performing their regular duties for the participant. Insurance coverage and any <br />financial compensation shall be the responsibility of each parry for its own <br />personnel and equipment. Each parry waives the right to sue the other parry for <br />any worker's compensation benefits paid to its own employee or volunteer even if <br />the injuries were caused wholly or partially by the negligence of any other parry, <br />its officers, employees, or volunteers. <br />Other specialized emergency and non-emergency services may be requested <br />and/or provided by the participants to this Agreement. There is no obligation on <br />the part of the participants to provide specialized emergency or non-emergency <br />services. <br />No charge shall be made to either party for assistance rendered under this <br />Agreement. Provided, however, that in the event the City that is requesting <br />assistance under this Agreement is reimbursed for said personnel, equipment, or <br />any other costs, from a party or parties responsible for the emergency, or <br />otherwise reimbursed by a third parry source, then reimbursement, on a pro-rata <br />basis, shall be made to the responding party for any equipment or personnel <br />charges. Proper written documentation of expenses must accompany a request for <br />reimbursement. <br />
