2.6 Section 1104.04E, City Code, outlines the procedure for a minor subdivision. No <br />Planning Commission hearing or review is necessary. A hearing is held by the City <br />Council. If the Council approves the request is approved, the staff, prior to recording <br />with the Ramsey County Recorder, must review a certificate of survey and a quit claim <br />deed for compliance with the Council's approval. <br />3.0 STAFF FINDINGS & CONDITIONS <br />3.1 Parcel B meets all dimensional and area requirements for new lots created within "R-1", <br />Single Family Residential District. Parcel A and C are not buildable lots and will be <br />attached to existing parcels that currently meet the minimum standards of the Single <br />Family Residential District. <br />3.2 The proposed minor subdivision should provide a five-foot wide utility and drainage <br />easement along each of the property iines (interior) of Parcel B. <br />3.3 A detailed grading plan with the building slab or first floor elevation and drainage <br />depicting directional flow must be submitted to the City Engineer for review and <br />approval prior to building permit issuance for Parcel B. <br />3.4 Because no new lots are being created, parkland dedication or fee in lieu of land <br />dedication is not necessary for this minor subdivision. <br />3.5 The City policy is to accept a Sewer Availability Charge (SAC) upon the issuance of a <br />buildingpermit. In this case, a SAC fee is required and will be collected upon the <br />issuance of a building permit for Parcel B. <br />3.6 The City Engineer must review and approve the driveway curb cut along Brenner Avenue <br />prior to the issuance of building permits. <br />3.7 The applicant must record the three lot minor subdivision within 60 days after the <br />approval of the City Council. <br />3.8 Parcels A and Parcel C shall be combined with appropriate adj acent parent parcels. The <br />property owner of 852 Brenner Avenue shall combine Parcel A with the existing lot and <br />the property owner of 3032 Victoria Street shall combine Parcel C with the existing lot. <br />This combination should take place �.�pon the purchase each parcel from Mr. Zimmer. <br />4.0 STAFF RECOMMENDATION <br />The City staff has reviewed this minor subdivision proposal and concluded it meets the <br />requirements of the Comprehensive Plan and Zoning Ordinance. Based on these findings <br />and subject to the conditions listed in Section 3.2 through 3.8, the City staff recom.nends <br />approval of the proposed minor subdivision by William Zimmer. <br />RCA (06 1200)Page 2 of 3 <br />
