° :'. , `.� `� ,i <br />GROUND LEASE, DEVEL ~� 1��1� �� AGREEMENT <br />This Agreement dated , 2000, is by and between the CITY OF <br />ROSEVILLE, a Minnesota municipal corporation ("Lessor"), and WILDLIFE <br />REHABILITATION CENTER OF MINNESOTA, a Minnesota non-profit corporation <br />("Tenant") <br />1. GRANT OF LEASE. In consideration of the mutual covenants and agreements <br />hereinafter set forth, the Lessor does hereby lease to Tenant and the Tenant does hereby rent from <br />the Lessor the land described in the attached Exhibit "A" ("Property"). Tenant may construct and <br />shall own improvements ("Improvements") on the Property subject to the provisions of this <br />Agreement. The proposed and limited use of the Improvements and the unique character of the <br />Tenant are an integral part of the consideration of the Lessor's leasing the subj ect properry, which <br />is part of the Lessor's Central Park. Without the Tenant's mission of wildlife care and related <br />public education, the Lessor would not lease the subject property; nor would the proposed use <br />qualify as a legal use of the property without the joint operational and use elements between the <br />Lessor and Tenant specified in this Lease. <br />2. TERM. This Lease sha11 be for a term of twenty (20) years, commencing on the <br />1�` day of August, 2000, and shall terminate on the 31st day of July, 2020, unless sooner <br />terminated in accordance with the other terms of this Lease. At Tenant's option, this Lease may <br />be extended for additional ten (10) year lease periods up to two (2) renewals. This Lease shall <br />terminate if construction of the Improvements specified herein do not commence by December <br />31, 2002. <br />3. RENT. Tenant agrees to pay Lessor an annual rental of One Dollars ($1 .00). <br />
