4.3 The unique physical features (situations) within the proposal that could justify a variance <br />include.. . <br />4.4 The economic issues that may (in part) justify a variance include ... <br />4.5 The alternative designs that allow use of the site but do not require a variance include.. . <br />4.6 The impacts of the project, if the variance was issued, would (would not) create significant <br />community impacts on the health, safety, or general welfare including.. . <br />4.7 Other findings deemed appropriate by the City Council.. . <br />Conditions of CUP approval: <br />4.8 Staff recommends attaching conditions to the CUP that minimize adjacent residential impacts and <br />limit future use of the property. <br />4.9 The parcel shall be limited to a rear yard lot coverage of 45% or 832 square feet. <br />4.10 The proposed detached accessory building and hard surface driveway expansion, if not five feet <br />from the property line, must either be relocated to the five foot side yard setback or the applicant <br />must apply for a setback permit. <br />4.11 All roof drainage created by the new structure must be collected in gutters and channeled to the <br />natural drainage way within the applicant's property. <br />4.12 The e�terior of the building must be of similar materials and color of the home. <br />4.13 Because of the size of the new structure (832 s.f.) and lot coverage, no other accessory building or <br />tool shed may be permitted on the property. <br />4.14 The maximum height (as defined in Section 1004.01) shall be 15 feet, to the midpoint of the roof. <br />4.15 The existing detached accessory structure must be razed and removed from the site. <br />4.16 Prior to issuance of a building permit, and within 60 days after approval of the conditional use <br />permit, the applicant must record the conditional use permit with the Ramsey County Recorder. If <br />not recorded within 60 days from the approval date, the conditional use permit and variance <br />expires. However, the applicant can (within the 60 days) apply for an extension. <br />4.17 This conditional use permit expires 6 months after approval if a building permit has not been <br />issued.
