D. There is not a reasonable alternative design that could be accomplished without a <br />variance. <br />E. Granting the variance would not significantly impact the health, safety or general <br />welfare of the community. <br />F. Granting of the variance is in keeping with the spirit and intent of the ordinance. <br />G. The variance should be limited to an increase in the residential lot coverage from <br />30% to 39. S%. <br />WHEREAS, Roseville Planning recommended (7-0) denial of the conditional use permit <br />based on the following findings: <br />A. The proposed use, lot coverage, and size of the accessory building are not compatible <br />with adj oining properties and is not consistent with the Comprehensive Plan. <br />WHEREAS, the Roseville City Council received the Planning Commission's <br />recommendation on Monday, July 24; and <br />WHEREAS, the Roseville City Council determined the Planning Commission's findings <br />for both the variance and conditional use permit to a true and accurate basis for granting the <br />requested variance and denying the conditional use permit. <br />NOW THEREFORE BE IT RESOLVED by the City Council (the "Council") of the City <br />of Roseville, Minnesota (the "City"), Ramsey County, Minnesota, that an 9.5% variance to <br />Section 1004.0 lA 13 of the Roseville City Code, allowing construction of a detached garage and <br />hard surface area at property located at 1858 Hamline Avenue (PID # 152923420 122) be <br />approved. <br />AND BE IT FURTHER RESOLVED by the City Council (the "Council") of the City of <br />Roseville, Minnesota (the "City"), Ramsey County, Minnesota, that a request by Robert <br />Reichenbach & Gail Anderson for a conditional use permit to allow an increase in allowable rear <br />yard area from 40% to 45% be denied, based on the findings or the Planning Commission, dated <br />July 12, 2000. <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member , and upon vote being taken thereon, the following voted in favor: <br />and the following voted against the same: <br />WHEREUPON said resolution was declared duly passed and adopted. <br />
