improvement to be placed on the Properry or to be rebuilt thereon unless it shall be stipulated in <br />and be a condition of such contract that no lien shall arise or be claimed on account of such <br />contract or on account of any work done or material furnished under the contract. <br />Tenant agrees to provide evidence to Lessor that Tenant has raised sufficient funds to <br />make all of the improvements in the Plans needed to provide a safe and secure Facility prior to <br />beginning construction. Tenant shall pay all permit fees, and other charges, imposed by the <br />Lessor. At Lessor's discretion, Tenant shall deposit all construction funds with a title company <br />or other disbursing agent to ensure the security of construction financing, and shall enter into a <br />disbursement agreement with the title company or disbursing agent acceptable to both Lessor and <br />Tenant. Tenant shall pay all charges imposed by the title company or disbursing agent. Tenant <br />shall not encumber the properry with any mortgage or secure any other debt regarding the facility <br />or improvements on the leased premises without the express written authorization of the Lessor. <br />6. USE. The Facility will function as both a not for profit wildlife veterinary hospital <br />and a public education center operated exclusively by the Wildlife Rehabilitation <br />Center of Minnesota. Tenant may use part of the facility as a gift/bookstore. No <br />change in use or significant change in operations may be made by Tenant without the <br />express written authorization of the Lessor. Tenant shall make the public education <br />center portion of the Facilities available on a scheduled, or on an unscheduled space- <br />available basis for use by the Lessor. Lessor and Tenant shall coordinate programs <br />and activities to minimize and manage parking, traffic, and other concerns. <br />7. COVENANTS, REPRESENTATIONS, AND WARRANTIES. Tenanthereby <br />covenants, represents and warrants that during the term of this Lease (i) all of the improvements <br />will be designed and constructed in accordance with the approved design, plans and <br />
