specifications, and maintained in a safe and sanitary manner in full compliance with all applicable <br />laws, ordinances and codes, and shall maintain the property and Improvements <br />complimentary and consistent with city facilities and public areas. If Tenant fails to <br />maintain the property or Improvements as required by this paragraph, as determined by <br />Lessor, the Lessor may enter the property or Improvements following reasonable notice and <br />opportunity to cure which shall not be less than forty-eight (48) hours for non-structural <br />violations and thirty (30) days for structural violations, repair or remedy the violation, and <br />add the cost of its actions to the rent, which shall be due for payment at the outset of the <br />succeeding lease year. <br />8. HOURS OF OPERATION. The Facility may be open only during the hours of 5 <br />a.m. to 10 p.m. for public access, business and support deliveries, and maintenance except as <br />expressly authorized by the Lessor in writing. Staff and volunteers may use the facility outside <br />the above-stated hours as needed for veterinary care, but shall not admit or discharge animals <br />outside the above-stated hours except in the case of emergencies. <br />9. ASSIGNMENT AND SUBLETTING. During the term of this Lease, Tenant <br />may not, without the express written consent of Lessor, assign this Lease or any interest herein, <br />or sublease all or any part of the Property, or in any way allow any other person to use its <br />facilities without the express written consent of Lessor. <br />10. INDEMNIFICATION OF LESSOR. Tenant shall indemnify and save harmless <br />Lessor from and against all liabilities, obligations, losses, damages, penalties, claims, actions, <br />suits, costs, charges, and expenses, included reasonable attorney's fees, which may be imposed <br />upon or incurred by or asserted against Lessor in respect of any use, nonuse, or condition of the <br />Properry created by Tenant or attributable to Tenant's use or manner of use of the Property.
