requirements. No destruction of, or damage to, the Facilities, other improvements, or any part <br />thereof by fire or any other casualty shall permit Tenant to surrender this Agreement or shall <br />relieve Tenant from its liability under the terms and conditions of this Agreement including <br />additional rent payable under this Agreement, and Tenant waives any rights now or hereafter <br />conferred upon it by statute or otherwise to quit or surrender this Agreement or the Facilities <br />or improvement or any part thereof. <br />Tenant agrees to protect and save Lessor from any claims for injuries to property or <br />person, or death, resulting from accident or other happening on the Property, and to carry <br />comprehensive general liability insurance in the amount of $1,000,000.00 to protect both Lessor <br />and Tenant. During the term of this lease, Tenant shall maintain insurance in the above- <br />specified amount or in an amount equal or greater to the cumulative damage limitation <br />established in Minnesota Statutes Chapter 466, or such other amount approved by the lessor <br />in writing. Lessor shall be named as an additional insured on the policy. Such insurance sha11 be <br />written in a company or companies authorized to engage in the business of general liability <br />insurance in the State of Minnesota, and there shall be delivered to the Lessor customary <br />certificates evidencing such paid-up insurance, which certificates are to be issued by the insurance <br />companies and which certificates shall further' provide that such liability insurance may not be <br />cancelled unless the Lessor is notified in writing ten (10) days prior to any such proposed <br />cancellation. <br />12. UTILITIES. Tenant shall be responsible for securing the provision of any utility <br />services and for the payment of all utility costs including but not limited to sewer, water, gas, <br />electric, refuse, cable television. Lessor shall grant any additional easements necessary to serve <br />the property with utilities, said easement locations to be determined by Lessor. <br />6 <br />
