REQUEST FOR CITY COUNCIL ACTION <br />DATE: 10/23/00 <br />ITEM NO: T _ � <br />� pproval: Mana er Approved: Agenda Section: <br />`��� � LAND USE <br />Item llescription: A request by Roberta Sladky, 382 North McCarrons Boulevard for a <br />variance from Section 10 16.22A 1(Non-Conformities), Section 10 16.16 <br />(Structure Design Standards), and Section 1004.02D5 (Dwelling <br />Dimensions and Appearances and Height, Frontage, Yard and Lot Area <br />Requirements in R-1 Districts) of the Roseville City Code. (PF3266) <br />1.0 REQUESTED ACTION <br />1.1 Roberta Sladky, 382 North McCarrons Boulevard, is requesting variances from Section <br />1016.22A1, Section 1016.16A, and Section 1004.02D5 of the Roseville City Code to <br />allow the replacement of a 25 foot by 11.5 foot (307 sq. ft.) four-season porch. The <br />variances include: 1) A pre-existing non-conforming lot; 2) a pre-existing non- <br />conforming house within the required 75-foot shoreland setback; 3) and a pre- <br />existing structure located within the required side yard setback. <br />2.0 REVIEW of REQUEST <br />2.1 Section 10 116.22A1(Non-Conformities) stipulates that non-conformities can continue <br />but are subject to applicable State Statutes and City Ordinance regarding alterations, <br />repair after damage, discontinuance of use, and intensification of use. The Sladky lot is a <br />pre-existing oddly shaped lot that extends out into Lake McCarrons. The lot width <br />(approximately 48 feet) is less than the 100 feet of shoreline frontage required by the City <br />Code. A buildable pre-existing non-conforming lot of record must have a minimum lot <br />width of 70 feet (70% of the standard 100 foot wide shoreland lot). <br />2.2 Section 10 16.16 (Structure Design Standards) requires structures to be set back a <br />minimum of 75 feet from the ordinary high watermark (OHV�. The proposed <br />replacement of the former four-season porch lies approximately 33 feet from the <br />shoreline of Lake McCarrons or 42 feet into the required 75 foot setback. <br />2.3 Section 1004.02D5 (Dwelling Dimensions and Appearances and Height, Frontage, Yard <br />and Lot Area Requirements in R-1 Districts) requires a front yard (road side) setback of <br />30 feet, and a five foot side yard setback. The Sladky property lies on the north side of <br />Lake McCarrons with a private drive from North McCarrons Boulevard and no public <br />frontage on a road. The pre-existing, non-conforming setback from the west side of the <br />property is 2.9 feet. <br />2.4 The removal of the former porch was precipitated by water damage. The Sladkys were in <br />the process of remodeling the four-season porch when they discovered extensive damage <br />to the structural support joists of the roof and walls due to water and carpenter ants.
