Notwithstandi ng anythi ng i n thi s°� �"r'�� Ordi nance to the contrary, the City may seize and destroy an ani mal that . has: a. inflicted substantial or qreat bodily harm on a human on public or private property without provocation; b. inflicted multiplebiteson ahuman on publicor privateproperty without provocati on; c. bit multi pl e human vi cti ms on publ i c or private property i n the same attack without provocation; or d. bit a human on publ ic or private property without provocation i n an attack where more than one ani mal parti ci pated i n the attack. The Owner of the ani mal and persons that have suffered i ni ury or damaqe from the ani mal shal I be qiven written noticeof thed�ermination of theanimal asdanqerous. Thenoticeshall provide: a. a descri pti on of the ani mal ; the authority for and purpose of the danqerous ani mal decl arati on, and seizure, if applicable; thetime, place, andcircumstancesunderwhichtheanimal wasdeclareddanqerous; and the telephone number and contact person where the ani mal i s kept; b. that the Owner of the ani mal may request a he�ari nq concerni nq the danqerous ani mal decl arati on; fai I ure to do so withi n 14 days of the date of the noti ce wi I I termi nate the owner's ri qht to a he�ari nq; c. that if an appe�al request is madewithin 14 days of the notice, the Owner must immediately com�ly with the requi rements of paraqraphs D(1) and (3) of thi s subdivi si on, and unti I such ti me as the he�ari nq off i cer i ssues an opi ni on; d. that i f the he�ari nq off i cer aff i rms the danqerous ani mal decl arati on, the Owner w i I I have 14 days f rom the date of the determi nation to com�ly with al I other requi rements of this subdivision; e. that al I actual costs of the care, keepi nq, and di spositi on of the ani mal are the responsi bi I ity of the person cl ai mi na an i nterest i n the ani mal . exceat to the extent that a court or he�ari na off i cer f i nds that the sei zure or impoundment was not substantially i ustified by law; and f. aform for notifyinq the City of an appe�al and requestinq a he�arinq under thissubdivision;. G. A�pe�al of DanqerousAnimal D�ermination. 1. The Owner of an ani mal d�ermi ned to be danqerous may appe�al the danqerous ani mal determi nati on. 2. Thewritten noticeof appe�al must be received by theCity within 14 daysfrom thedateof thedanqerous ani mal d�ermi nati on. 3. The he�ari nq on the appe�al of a danqerous ani mal d�ermi nati on shal I be before a he�ari nq off i cer. The he�ari nq off i cer shal I be the A ni mal H umane Soci �y D i rector of H umane I nvesti qati ons, or thei r desi qnee. 4. The he�ari nq shal I take pl ace withi n 14 days of the recei pt of the noti ce of appeal . 5. I n the event that the danqerous ani mal d�ermi nati on i s uphel d by the he�ari nq offi cer, actual expenses of the he�ari nq, up to a m�ci mum of $1,000, wi I I be the responsi bi I ity of the ani mal' s owner. 6. The heari nq officer shal I issue a decision on the matter withi n ten days after the he�ari nq. The decision must be del ivered to the ani mal's owner by hand del ivery or reqi stered mai I as soon as practi cal and a copy must be provided to the City. SECTI ON 2: Effective date.
