Department Approval <br />� �. <br />l�'�, <br />Jy <br />REQUEST FOR COUNCI L ACTI ON <br />Date: 02/08/2010 <br />Item No.: 7.g <br />Ci ty M anager A pproval <br />� / <br />I tem Descri ption: Approve Contract with Braun I ntertec to U ndertake Subsurface Testi ng and <br />Compl �e Remedi al PI anni ng for the Twi n L akes Phase I I Publ i c I nf rastructure <br />Proj ect <br />'I.O BACKGROUND <br />On September 21, 2009, the City Counci I approved a contract with Braun I ntertec to compl�e a <br />Voluntary ResponseAction Plan (RAP) and Construction Contingency Plan (CCP) forthePhase2 <br />i nf rastructure proj ect, w hi ch i s a necessary acti on to move forward wi th the constructi on of the <br />i nf rastructure proj ec;t. A RA P i s an envi ronmental pl anni ng document that characteri zes envi ronmental <br />contami nati on and d�ai I s how the contami nati on wi I I be remedi ated. The M i nnesota Pol I uti on Control <br />Agency' s V ol untary I nvesti gati on and CI e�anup Program requi res that an appl i cant submi t a RA P f or <br />agency revi e�v and approval i n order to reca ve a I�ter of no f urther acti on for the area. <br />On October 6, 2009, Braun I ntertec submitted a RAP/CCP to PCA for its revie�v. The m�hodologies <br />used i n thi s pl an where the same as those prescri bed i n the RA P that was approved for the Phase 1 <br />i nf rastructure are�a. On December 29, 2009, the Ci ty reca ved a I�ter f rom the PCA requesti ng <br />additional i nvestigation is necessar�y withi n the Phase 2 are�a before the PCA can approve the RAP due <br />to the proximity of known groundwater contamination. (Attachment B to revie�v the I�ter.) <br />Staff requested that B raun I ntertec devel op a scope of work that woul d meet the request made by PCA <br />for f urther �ent i n order to obtai n an approved RA P/CCP for the Phase 2 i nf rastructure area <br />without conducting subsurface investigation on land that is not owned by the City and/or outside of the <br />scope of thi s proj ect. Attachment B i s the proposal f rom B raun to undertake the requested soi I and <br />water sampl i ng, testi ng, and anal ysi s as wel I as revi si ng the RA P/CCP. <br />Z.O POLICY OBJECTIVE <br />By undertaki ng the devel opment of the RA P, the Ci ty i s posi ti oni ng itsel f to take advantage of regi onal <br />and state f i nanci al resources for envi ronmental cl e�anup. Pol i cy 4.3 of the Economi c Devel opment and <br />Redevel opment Chapter of the 2030 Comprehensi ve PI an supports thi s acti vi ty. I t states: " Foster <br />environmental remediation of polluted property through partnershipswith property ownersand funding <br />agenci es." <br />3.O FI NANCIAL I M PACTS <br />The City i s not i mpacti ng the general fund by authorizi ng thi s$16,260 eacpenditure.
