For p�rposes o#� this <br />poIicy, ref�renc� to Council NCembers includes members of all o�her City committees and <br />groups subject ta the Open i1!Iee�in� Law. Reference to the Cauncil shaZl include all such <br />groups and meetings. <br />Thi�� Policy applies io all electror�ic communications con�air�ing governrnent data, as <br />defined by ihe Minnesota Governrr�ent Data Practices Act, Minn. �hapter 13, regardless <br />of whether the Cauncil Member is using a City-provided email address and account, <br />his/her personal email address or account, or one provided by his/her employer. <br />I. Pur�ose <br />This Policy is adopted ta increase awareness of the r�sks associated �ith Council <br />1Vlembers using electrot�ic communications and to set forth �he apprapriate restricttons on <br />th� use of electronic comm�nications i� accordance with the Minnesota Open Meeting <br />Law and Minnesota Government Data Prac�ices Act. <br />Electronic communications may be classified as public data; and thus, may be subject to <br />p�iblic disclosure, <br />TY. L�efinitions <br />"Electronic communicatians" include email, texting, instant messagin�, chatrooms, and <br />related electronic means of communicating with others.. <br />"Ciiy Manager" means the City Manager or his/her designee. <br />III. Commur�icaiions with meml�ers of �he ubl�c <br />Members of the public cannat require conitdentiality when electronically <br />cammunica�ing with Council Members on matters o� �it� business. <br />Correspandence between individua�� and etected officials is private data on <br />indiv�duals, but inay be made pub(ic by either the sende�' or the recipier�t as <br />provided by Nlinnesota Statutes Section 13.60�, subd. 2, <br />
