<br /> <br />Housing & Redevelopment Authority <br /> <br /> <br />Roseville City Hall Council Chambers, 2660 Civic Center Drive <br />  <br />Minutes – Tuesday, April 21, 2009 at 6:00 p.m. <br /> <br /> <br />  <br /> <br />1.Call to Order <br /> <br />Chair Maschka called to order the regular meeting of the Housing & Redevelopment Authority (HRA) <br /> <br />in and for the City of Roseville at 6:00 p.m. <br /> <br /> <br />Chair Maschka noted that there was a not a quorum present, so opened with a presentation by Steve <br /> <br /> <br /> <br />Bubul, Roseville HRA Attorney. <br /> <br /> <br /> <br /> <br />  <br />1.Presentations <br /> <br /> <br /> <br /> <br />  <br />a.Multi-Family Discussion – Steve Bubul, RHRA Attorney <br /> <br /> <br />Executive Director Patrick Trudgeon introduced Mr. Steve Bubul of Kennedy & Graven. <br /> <br /> <br /> <br /> <br />Mr. Bubul thanked the HRA for retaining them as counsel; and provided an overview of the <br /> <br /> <br />role of the HRA and its involvement in multi-family housing, specific to the City of Roseville, <br /> <br /> <br />as detailed in a memorandum from the Kennedy & Graven office dated April 15, 2009. Mr. <br /> <br /> <br />Bubul discussed two (2) concepts: those of a regulatory nature dictated by the City Council; <br /> <br /> <br />and the HRA taking direct action on multi-family properties. <br />  <br /> <br /> <br />Various topics discussed by Mr. Bubul included specific regulatory actions of a City Council <br />  <br />including rental license ordinance; tenant remedies actions; nuisance ordinance. <br />  <br />  <br />Mr. Bubul reviewed several options for the HRA’s direct involvement for eminent domain <br />  <br />with the HRA acquiring and later reselling the building or operating it as housing for low- or <br />  <br />moderate-income tenants; and allowing that would meet the authority of the HRA in providing <br />  <br />affordable housing options and in preventing or removing blighted properties; and specific <br /> <br /> <br /> <br />bonding authority for General Obligation Bonds for such projects. <br /> <br /> <br /> <br /> <br />  <br />Discussion among members, staff and Mr. Bubul included tracking the number and type of <br /> <br /> <br /> <br />police calls as they related to rental and provisional licensing (i.e., City of New Brighton); <br /> <br />  <br />additional information on inspection fees/unit; problems with current limited access to multi- <br /> <br /> <br />tenant buildings to determine serious issues that may be present, as evidenced with several <br /> <br /> <br />buildings in the community to-date; if there were unintended consequences (i.e., tenants being <br /> <br /> <br />reticent to call the Police Department with landlord concerns); and positive responses if <br /> <br /> <br />problem landlords determine that the rental licensing and compliance is too cumbersome and <br /> <br /> <br />their ultimate decision to sell the property and eliminate the initial problem. <br /> <br /> <br /> <br /> <br />Further discussion included the City of New Brighton example with a six (6) month <br />  <br />provisional license for problem properties for compliance; a majority of problems being <br /> <br /> <br />resolved by landlords; resolution of tenant disputes; nuisance ordinances used as an alternate <br />  <br />or supplement for creating an incentive for landlords or resulting assessment, basically for <br />  <br />capital items rather than crime-related issues; and civil actions to remedy tenant issues (i.e., <br />  <br />City of Brooklyn Park example) <br />  <br />  <br />Members asked that staff have the Police Department at a meeting in the near future for further <br />  <br />discussion of crime-free multi-housing, with August suggested for this presentation. <br /> <br /> <br /> <br /> <br />Additional discussion was held with Mr. Bubul on rationale in issuing General Obligation <br />  <br />versus Revenue Bonds; availability of Tax Increment Financing (TIF); recognizing that each or <br /> <br /> <br />any of those options would be at the discretion of the City Council. <br />  <br /> <br />
