Revised 1-10-06 – changes redlined <br /> 3 <br />Section 907.08. Method of Renewal. 1 <br />1. Each new (non-renewal) license issued pursuant to this Section, and each renewal license issued 2 <br />after the effective date of this ordinance, shall expire on the 31st of December of each year 3 <br />following the year in which the initial license was issued. The City shall mail annual renewal 4 <br />applications for a license to the property owner or the designated agent on or before September 5 5 <br />of each year. Failure to receive a renewal applicat ion for license from the City, however, shall not 6 <br />excuse the owner from meeting the license requireme nts. Renewal applications for license may be 7 <br />returned by mail, at the property owner’s risk, to the City. Renewal of licenses will not occur 8 <br />unless the renewal fee has been paid and the property has been inspected, and found to be in 9 <br />compliance by the compliance officer, within the 90 day period prior to the expiration date of the 10 <br />annual license. It is the owner’s responsibility to ensure ample time is planned for 11 <br />accommodating the renewal inspection before the license expires. All properties that have 12 <br />received a compliance letter without any violations within 12 months are not subject to a 13 <br />reinspection for 24 months from the date of the last inspection except when there has been a 14 <br />change in tenant or ownership or the rental license office has received a compliant on the 15 <br />property. 16 <br /> 17 <br />Section 907.09. Method of Correction. Whenever the compliance officer determines that any residential 18 <br />rental property fails to meet the requirements set fort h in applicable rules, standards, statutes or 19 <br />ordinances the City shall issue a correction order setting forth the violations and ordering the occupant, 20 <br />owner and/or owner’s designated agent to correct such violations. This notice and order shall: 21 <br />1. Be in written form; 22 <br />2. Describe the location and nature of the violation; 23 <br />3. Establish a reasonable time for the correction of any violation; 24 <br />4. Be served upon the owner, the owner’s designated agent and/or the occupant as the case may 25 <br />require. Such notice shall be deemed to be properly served if a copy thereof is: 26 <br />A. Served upon the owner, designated agent and/or occupant personally; or 27 <br />B. Sent by first class mail. 28 <br /> 29 <br />Failure to correct violations within the time peri od stated in the correction order shall result in an 30 <br />administrative penalty to be set by Council resolution under Section 907.04 hereof, as well as other 31 <br />sanctions provided by law or this ordinance. If th e correction order relates to actions or omissions of the 32 <br />occupant, and the occupant fails to make the necess ary correction, the licensee may be required to remedy 33 <br />the condition by whatever means necessary including but not limited to the use of Roseville City Code 34 <br />Sections 407.06, 407.07 and 407.08. 35 <br /> 36 <br />Section 907.10 Transfer of Property. To transfer the license from one property owner to another, the 37 <br />licensee shall give written notice to the City of the proposed transfer, wi thin thirty days (30) after such 38 <br />transfer. The transferee must make application with the City and pay the required fee for a transfer of the 39 <br />license within 30 days after the transfer of property. The notice shall include the name and address of the 40 <br />transferee. Failure to make application within the sp ecified time limit shall result in automatic forfeiture 41 <br />of the license. Re-licensing of any property for which the license has been forfeited shall require 42 <br />application for a new license. Issuance of any license when there is a transfer of property shall require the 43 <br />property to be in compliance with all requirements of th e applicable rules, codes, statutes and ordinances. 44 <br />The fee for license transfer shall be set by annual Council resolution. 45 <br /> 46 <br />Section 907.11. License Suspensions and Revocation. 47 <br />Any license may be revoked or suspended at any time during the life of said license for grounds 48 <br />including, but not limited to the following: 49 <br /> 50
