Nothing in this Section shall prevent the City from taking action under any 1 <br />applicable rule, standard, statute or ordinance for violations thereof to seek either injunctive relief or 2 <br />criminal prosecution for such violations as therein provided. Nothing contained in this Section shall 3 <br />prevent the City from seeking injunctive relief against a property owner or designated agent who fails to 4 <br />comply with the terms and conditions of this Section on registration and licensing including an order 5 <br />prohibiting the occupancy of such rental units until violations of this Section have been remedied by the 6 <br />property owner or designated agent. 7 <br /> 8 <br />Section 907.19. Posting. Every property owner or agent of residential rental property must , within 24 9 <br />hours, present a copy of the current license when requested by the compliance officer. 10 <br /> 11 <br />Section 907.20. Inspection Access. Property owners and their agents shall permit, during regular 12 <br />business hours, the compliance officer to inspect all pr emises governed by this section to determine if the 13 <br />building is operated as a rental property and/or to determine compliance with the provisions of this 14 <br />section, and shall fully cooperate with such inspections . The property owners or their agents shall notify 15 <br />tenants of planned inspections of their rental units. 16 <br /> 17 <br />If an owner, occupant, or other person in charge of a dwelling or dwelling unit fails or refuses to permit 18 <br />free access and entry to the structure or premises, or any part thereof, for an inspection authorized by this 19 <br />section, the compliance officer may, upon a showing that probable cause exists for the inspection or for 20 <br />the issuance of an order directing compliance with the inspection requirements of this section with respect 21 <br />to such dwelling or dwelling unit, petition and obtain an order to inspect and/or an administrative warrant 22 <br />from a court of competent jurisdiction. Except as specifically authorized to the contrary by the court, 23 <br />administrative warrants under this section shall be executed at reasonable times and after reasonable 24 <br />efforts to give the owner (or other person in charge) and the occupant at least 5 business days written 25 <br />notice of the date and time of the inspection author ized by the warrant. Property owners shall cooperate 26 <br />in the execution of all administrative warrants a nd court orders, including providing access and entry to 27 <br />rented premises where directed to do so. An author ized representative of the property owner shall be 28 <br />present on the premises during inspections; however, failure of a property owner to comply with this 29 <br />requirement shall not deprive the Ci ty of the authority to inspect. 30 <br /> 31 <br />Failure of a property owner to obey any of the requirements of this subdivision shall subject the property 32 <br />owner to suspension or revocation of license, in addition to other remedies and/or penalties provided by 33 <br />law. Any such suspension or revocation shall continue until the inspection sought has been completed, 34 <br />any violations satisfactorily remedied, and any outstanding fees or penalties have been paid. 35 <br /> 36 <br />Section 907.21. Applicable Laws. Licensees shall be subject to all a pplicable rules, standards, statutes 37 <br />and ordinances giving use, maintenance, and occupanc y of the dwelling or dwelling unit; and this Section 38 <br />shall not be construed or interpreted to supersede any other such applicable rules, standards, statutes or 39 <br />ordinances. 40 <br /> 41 <br />Section 907.22. Tenant Requested Inspection. A tenant may at any time request an inspection of the 42 <br />rental property in which he/she currently resides if the request relates to a health and safety issue. A fee 43 <br />for such inspection shall be imposed on the tenant only if the City finds that the request was made in bad 44 <br />faith. 45 <br /> 46 <br />Section 907.23 . Notice to Tenant .
