ORDINANCE NO. 1002 <br />Page 4 <br /> <br /> <br />4 <br />118908 <br />11/14/05 <br /> <br /> 3-28-5 : EXCEPTION : A property owner that leases the subject property as set forth on <br />the following list is exempt from this Ordinance: <br /> <br />A. Retail/Commercial/Industrial rental activities. <br />B. Nursing homes as licensed by the State Department of Health and Human <br />Services. <br />C. Assisted Living facilities as licensed by the State Department of Health and <br />Human Services. <br /> <br /> <br /> 3-28-6: INSPECTIONS: <br /> <br />A. Single Family Dwellings shall be inspected in their entirety at the Property <br />Owner’s expense following any violation of this ordinance, the City Code, <br />Building Code or the Uniform Fire Code, and thereafter on a schedule as may be <br />adopted by the City. <br />B. The Common Areas of multi-family dwellings shall be inspected on a schedule as <br />may be adopted by the City. Common Areas inspections may be waived for <br />participants in the STAR Program as set forth in this Ordinance. <br />C. As a condition of re-obtaining a license for a unit that has been revoked, the unit <br />at issue shall be inspected at the Property Owner’s expense as set forth in the <br />City’s fee schedule. <br />D. Any code violation noted by the City must be remedied in a timely fashion by the <br />Property Owner and re-inspected for compliance by the City. <br /> <br /> <br /> 3-28-7: ISSUANCE OF LICENSE: The application will be reviewed and the <br />property will be inspected pursuant to Section 3-28-6. If the property meets applicable codes, <br />laws and ordinances, and fees have been paid, the Code Official shall recommend issuance of the <br />license. If the property is in substantial compliance with applicable codes and laws, and there are <br />no hazardous conditions, a license may be issued with the condition that violations will be <br />corrected within a specified time period. <br /> <br /> <br /> 3-28-8 : LICENSE FEE : The application fee shall be determined by the City Council <br />from time to time by resolution, and shall be paid at the time of application. License fees, as set <br />forth by City Council resolution, shall be due prior to the license expiration date; in the cases of <br />new unlicensed dwellings, license fees sha ll be due upon issuance of the certificate of <br />occupancy; in the case of licensing periods of less than one (1) year, license fees may be <br />prorated.
