Page 2 <br /> <br />B. Current Process – Per 407.06 (As per new Ci ty Policy in #6 of Prosecution <br /> Contact of November 18, 2002 –attach ed). The underlined information is the <br /> change created by the new policy. <br />1. Notice of violation to pr operty owner giving 14 da ys to correct violation. <br />2. Second notice of violation to property owner giving an other 14 days to correct <br />violation. Also a warning is included that failure to comply could result in an <br />Administrative Ticket ($100). <br />3. An Administrative Ticket ($100) is issued wi th a note stating that if the violation is <br />corrected within 7 days the ticket will be cancelled. <br />4. Codes Coordinator attempts to contact the pr operty owner and re solve the issue. <br />5. Codes Coordinator discusses the violation with both the Community Development <br />Director and the City Attorney. Both the CDD and the CA must agree a citation is <br />appropriate, and would be the most effective route to proceed with. <br />6. The Codes Coordinator writes up a notice to the violator stating that the City’s <br />intention is to issue a Rams ey County Court Citation. The no tice states that unless the <br />property owner corrects the viol ation within 30 days (30 days must be given to comply <br />with notificatio n requirements) the City Council will discuss the matter at a specified <br />date (set to occur after the 30 day notice requirement). Because this notification will be <br />part of the Council discussi on, it must be a detailed re port of all previous facts <br />involving the case (very time c onsuming). The notification is mailed by regular mail, <br />sent by certified mail and pos ted on the property in-order to comply with notification <br />requirements. <br />7. An RCA is written to be pr esented to Administration fo r potential placement on the <br />Agenda on a specified date (sometimes the ag enda for that meeting date is full, the <br />date must be changed and the notif ication process must begin afresh). <br />8. A week before the C ouncil Meeting an insp ection is conduc ted of the property and of <br />the violation. Most often th e situation has changed in so me significant way. The case <br />is often reevaluated at this point. The report must be re-written to explain the new <br />conditions and the RCA mu st be rewritten to refl ect the new conditions. <br />9. The day of the Council meeting the site is inspected again to see if conditions have <br />changed and if new information must be presen ted to Council. <br />10. Staff must be availabl e at the Council Meeti ng to answer questions. <br />11. If Council agrees that a Ramsey County Court Citati on is appropriate, a Ramsey <br />County Court Citation is wr itten (by the Codes Coordi nator) and mailed to the <br />violator.
