ORDINANCE # _________________ 1 AN ORDINANCE AMENDING TITLE 9 BY ADDING SECTION 907 TO THE CITY OF 2 ROSEVILLE CITY CODE REGARDING LICENSING AND INSPECTIONS OF 3 RESIDENTIAL RENTAL PROPERTY OF 1 TO 4 UNITS 4 5 THE CITY COUNCIL OF THE CITY OF ROSEVILLE ORDAINS: 6 7 Section 1. 8Section 907, hereby titled RESIDENTIAL RENTAL PROPERTY REGISTRATION 9AND LICENSING is hereby created as follows. 10 11 Section 907.01. Purpose. The City recognizes a need for an organized inspection program of residential 12 rental property with 1 to 4 units within the City in order to establish and enforce minimum standards for 13 small rental units to meet City and State safety, health, fire, and zoning codes within the City and to 14 provide a more efficient system to ensure that the rental property is properly maintained. The City 15 recognizes that the most efficient system to provide for rental inspections is the creation of a program 16 requiring the registration and license of all residential rental property with 1 to 4 units within the City so 17 that orderly inspections can be undertaken. 18 19 Section 907.02. Definitions. 20 211. The term “residential rental property” means any building, structure, room, enclosure, or mobile 22 home with one to four units including the real property upon which it is located and which 23 surrounds it, which is rented or offered for rent as living quarters. Residential rental property does 24 not mean on-campus college housing, hospital units, nursing home units, multiple rental property 25 over four units or hotels or motels with daily rental units, all of which shall be specifically exempt 26 from registration and license under this Section. 272. The term “person” includes natural persons as well as business entities, whether one or more. 283. The term “Roseville HRA” or “HRA” means the Housing and Redevelopment Authority in and 29 for the City of Roseville. The HRA is designated as the administer of the City of Roseville 30esidential Rental Property Registration and Licensing R Program. 314. The term “enforcement officer” means any person or agency designated by the Roseville HRA to 32 perform inspections and determine compliance with the applicable rules, standards, statutes and 33 ordinances. 34 35. Section 907.03. Registration and License Requirements It is unlawful for any person to hereafter 36 occupy, allow to be occupied, advertise for occupancy, solicit occupants of, or let to another person for 37 occupancy any residential rental property of one to four units within the City for which an application for 38 license has not been properly made and filed with the Roseville HRA and for which there is not an 39 effective license. Initial application and renewal shall be made upon forms furnished by the HRA for such 40 purpose and shall specifically require the following minimum information: 411. Name, address and phone number of the property owner and, if owner is not a natural person, the 42 name, address and phone number of a designated agent for the owner. 432. The name, phone number, and address of any person authorized to make or order made repairs or 44 services for the property, if in violation of City or State Codes, if the person is different than the 45 owner. 463. The street address of the rental property. 474. The number and types of units within the rental property (single family, duplex, triplex or 48 fourplex). 1
